Trip protection coverage, what do i do if i arrived at the destination airport, waited at the baggage carousel, and my luggage did not arrive.

When you discover your luggage did not arrive, locate the baggage desk in the airport terminal and inform the service agent to file a PIR (Property Irregularity Report). Once you submit a claim for your baggage in the Travel Delay +AutoPay portal using the 10-character PIR reference number, your luggage will be tracked and you will...

How will I receive the Travel Delay +AutoPay benefit?

You can choose to receive either an automatic cash payout (via Interac e-Transfer or Bank Transfer) or opt for an airport lounge pass (if available).

My flight’s departure was delayed before it was cancelled. What can I expect?

If you receive a Travel Delay +AutoPay benefit for a departure delay and your flight is subsequently cancelled, the value of your departure delay benefit will be subtracted from your flight cancellation payout.

What should I do if I experience any problems utilizing the Travel Delay +AutoPay services?

Please report any issues receiving your Travel Delay +AutoPay payout or lounge passes by emailing [email protected] or click “chat now” on bcaa.com to log your issue. Alternatively, you may submit a claim for reimbursements as outlined in bcaa.com/travelclaims.

What if I can’t find my flight in the Travel Delay +AutoPay portal?

If you cannot find your flight when registering your flight in the Travel Delay +AutoPay portal, you will be prompted to add your flight details manually.

I chose the automatic payout option through Travel Delay +AutoPay, what do I do now?

The processing time for automatic payments through Travel Delay +AutoPay varies by option. Bank transfers can take up to 5 business days, while Interac e-Transfers may take up to 30 minutes for Autodeposit or instructions. If you haven't received your automatic payment, you can claim eligible out-of-pocket expenses at www.bcaa.com/travelc...

I selected the lounge pass option, but I changed my mind. Can I get a cash payout instead?

Once the lounge pass is issued, you will no longer have the option to choose a cash payout. Therefore, during the Travel Delay +AutoPay benefit selection process, we encourage you to consider if the airport lounge pass is suitable for you.

What happens if the luggage desk does not provide the option to file a PIR (Property Irregularity Report)?

Please follow the standard reimbursement process by filing a claim for any eligible expenses at bcaa.com/travelclaims.

Will I still be able to file a claim to get reimbursed for expenses beyond the Travel Delay +AutoPay payments?

Yes, you may also submit a claim online to be reimbursed for additional eligible out of pocket expenses at bcaa.com/travelclaims.

Do I need to register all my travel flights with Travel Delay +AutoPay?

Yes, to receive the automatic payout for flight and baggage delays or cancellations, all flights, including connecting and return flights, must be registered at least 18 hours prior to the scheduled departure time.

Budget destinations for a cost-saving vacation

Who doesn’t need a vacation!? But if your bank balance is telling you to skip the trip and source props to mock up some dreamy Instagram pics instead, think again. It doesn’t have to be that way.

With a little research and smart planning, there are other ways to escape on a dream getaway without emptying your wallet.

Here are four ways to keep your costs down and still experience a memorable vacation to somewhere beautiful.

US city vacation

1. Find low-cost flights for a US city break

Getting a cheap flight is a big first step to an affordable vacation. Powerful travel search engines like Skyscanner , Kayak , Expedia , and Google Flights can be your best friends here – especially when they have an option to choose 'Travel Anywhere’, ‘Any Destination’ or ‘Explore Everywhere’.

Flights to cities in the US are frequently among the cheapest options due to shorter distances and higher volume. For instance, you can often find cheap flights to destinations like San Francisco (around $130-$200 roundtrip) or Fort Lauderdale (approx. $280-$350 roundtrip) during off-peak times.

If you live anywhere near the border, flying out of Seattle can be a cost-saving gateway to the rest of the US, as internal flights can be good value. Just make sure you factor in the expense of getting to Seattle-Tacoma International Airport and remember to start your travel insurance coverage from the beginning of your journey.

the Caribbean vacation destination

2. Snag a package deal to Mexico, Central America or the Caribbean

You know how you can bundle your phone, Internet and TV? The same cost-saving principle applies to travel. Often you can wrap the costs of your flight, resort, meals and fruity tropical drinks into one decent package price.

Mexico, Central American and The Caribbean Islands are common destinations for all-inclusive package deals offered by websites like Sunwing Vacations , Funjet Vacations , CheapCaribbean.com , CheapTickets , and All Inclusive Outlet  (which includes cruises).

Agent sites like SellOffVacations also offer last-minute deals which can save you a lot of cash. Keep an eye on their social media channels for their latest discount deals. If you’re looking for the chance to laze around a pool without the stress of choosing where to eat a dinner, this kind of trip is for you!

Looking to customize your own vacation package? Check out BCAA’s Trip Planner – where you can find the best value flights, hotels and transport and bundle them together.

Southeast Asia vacation destination

3. Live the good life on a shoestring budget in Southeast Asia

Yes, long-haul flights can be pricier. However, if you can find a flight that fits your budget, once you've arrived in Southeast Asia, you can eat, drink and entertain yourself more at a much lower cost than you can at home.

For instance, if you use the website BudgetYourTrip , which helps price up your daily travel expenses, you’ll only spend this much (all in $CAD) on food, transport and accommodation:

  • Thailand — average daily spend $29
  • Cambodia — average daily spend $29
  • Vietnam — average daily spend $30

And if you do your research, it’s not like you’re sacrificing the quality of your trip. You’ll find breathtaking beaches, crystal-clear waters, spectacular scenery and some of the tastiest food on earth!

Europe vacation destination

4. Want to travel Europe? Hit up some budget-friendly destinations

If you’re craving a trip to Europe, fair warning. Trips across the pond from Canada’s West Coast are usually very expensive. But instead of visiting the usual EU hot spots like the UK, Italy and Greece, consider zigging while everyone else is zagging.

Check out the Balkan countries where your money can go a long way compared to more tourist-heavy spots. Beautiful under-the-radar destinations like Albania, Bulgaria, Croatia and Montenegro offer you stunning landscapes, rich culture and affordable prices.

For some context, according to BudgetYourTrip , the average daily cost accommodation, food, local transportation and sightseeing in France is $345 per day. In Montenegro, it’s $154 a day. To save even more on travel costs, look for accommodations that come with a kitchen so you can prepare meals and save on dining out.

male friends sleeping in the flight

5. Bonus booking tip: Fly when most people are at their 9-5

Avoid the weekend prices and long lineups by booking your departures during the week. Flights tend to be cheaper—and airports less busy—from Monday to Thursday . Keep an eye out for good midweek deals at YVR Travel that posts deals out of Vancouver and YYJ Travel that posts deals on flights out of Victoria.

Protect your holiday budget

Remember to always check international travel advisories before you book and make sure you’re protected from additional expenses. The best way to avoid extra costs (and unexpected medical bills or stressful cancellations or early flights home) is to make sure you’re covered with travel insurance.

What travel insurance covers

How much does travel insurance cost, types of travel insurance, how to get travel insurance, what to look for in travel insurance, best travel insurance comparison sites, which insurance company is best for travel insurance, when to skip travel insurance, travel insurance, recapped.

Travel insurance can cover medical expenses, emergencies, trip interruptions, baggage, rental cars and more.

Cost is affected by trip length, pre-existing medical conditions, depth of coverage, your age and add-ons.

You can get it through credit cards or third-party companies, & can shop on travel insurance comparison sites.

Before buying, evaluate risks, know existing coverage, obtain quotes online and review policy details warily.

Skip it if you buy flexible airfare and hotels, already have coverage or only book refundable activities.

Booking travel always carries some degree of uncertainty. Travel insurance provides a safety net so you can step out with confidence. You may not need travel insurance for inexpensive trips, but it can provide a sense of security when you prepay for pricey reservations, a big international trip or travel during cold and flu season, which can be unpredictable.

According to insurance comparison site Squaremouth, travelers in 2023 spent an average of $403 for comprehensive coverage, compared to $96 for medical-only policies. Comprehensive plans typically cost between 5% and 10% of the insured trip cost.

Since that price tag is no small amount, it helps to know how to shop smart for travel insurance. Here's how to find the right travel insurance plan for you and your next adventure.

Depending on the type of coverage you’re looking for, the chart below will help you determine what to look for when selecting a policy:

Depending on the policy, travel insurance reimburses you or offers services when something goes awry. There’s even coverage for the worst-case scenario: if you die in an accident while traveling. Accidental death coverage pays your beneficiary a lump sum in that case.

Before you buy, take a little time to get familiar with different types of travel insurance products, how it’s priced, and what it covers and excludes. If you’re traveling during these uncertain times, you’ll want to make sure that the policy you select covers coronavirus-related emergencies. Usually, the more thorough the coverage, the more it will cost.

Travel insurance costs vary depending on:

Length and cost of the trip: The longer and more expensive the trip, the higher the policy cost.

Cost of local health care: High health-care costs in your destination can drive up the price of trip insurance.

Medical conditions you want covered: Conditions you already have will increase the cost of travel insurance coverage.

Amount and breadth of coverage: The more risks a policy covers, the more it will cost.

Your age: Generally the older you are, the higher the price.

Any optional supplement you add to your policy : Cancel For Any Reason , Interrupt For Any Reason and more.

Keep these factors in mind when considering different travel insurance options.

You’ll find a wide selection of travel protection plans when you shop for a policy.

Typically, travel insurance is sold as a package, known as a comprehensive plan, which includes a variety of coverage.

Here are seven of the most common types of travel insurance:

Travel medical insurance

These plans provide health insurance while you’re away from home. Although in some ways these policies work like traditional health plans, generally you cannot use travel health insurance for routine medical events. For example, a routine medical checkup is usually not covered. In addition, these policies often include limitations on coverage and exclusions for pre-existing conditions.

Although most travel insurance plans cover many recreational activities, such as skiing and horseback riding, they often exclude adventure sports, such as skydiving or parasailing, or competition in organized sporting events. You may need to buy a special travel policy designed for adventure or competitive sports.

International travel insurance

Most likely, your U.S.-based medical insurance will not work while you’re traveling internationally, and Medicare does not provide any coverage once you leave the United States outside of a few very specific exemptions. If you plan on traveling abroad, purchasing travel medical insurance could make a lot of sense.

Trip cancellation, interruption and delay

Trip cancellation coverage reimburses you for prepaid, nonrefundable expenses if the tour operator goes out of business or you have to cancel the trip for one of the covered reasons outlined in the policy, such as:

Your own illness.

The illness or death of a family member who’s not traveling with you.

Natural disasters.

Trip interruption insurance covers the nonrefundable cost of the unused portion of the trip if it is interrupted due to a reason outlined in the policy.

Trip delay coverage reimburses you for expenses such as lodging and meals if you’re delayed during a trip (e.g., your flight gets canceled due to weather ).

Many package policies cover all three. These policies are different from the cancellation waivers that cruise lines and tour operators offer, the Insurance Information Institute says. Waivers are cheap, ranging from $40 to $60, and often include restrictions. For example, according to the institute, waivers might not refund your money if you cancel immediately before departure. Waivers are technically not insurance policies.

Some companies offer additional layers of coverage at extra cost. “Cancel For Any Reason” coverage will reimburse a large part of the trip cost, no matter why you back out. And some companies let you pay extra to cover pre-existing conditions if you cancel for medical reasons.

Some insurers and comparison sites let you customize a policy by choosing types of coverage a la carte. For example, TravelInsurance.com is a comparison site that provides quotes from different providers.

Baggage and personal belongings

How does lost luggage insurance work? This coverage reimburses you for baggage and personal belongings that are lost, stolen or damaged during the trip. Some plans also reimburse you for extra expenses if you experience a baggage delay for more than a certain period, such as 12 hours.

Your renters or homeowners insurance may cover personal belongings while you are traveling. It’s best to review your homeowners insurance policy to determine the level of coverage it provides so you do not end up paying for a benefit you already have.

Emergency medical assistance, evacuation and repatriation

This coverage pays medical expenses if you get sick or injured on a trip . Medical evacuation coverage pays for transporting you to the nearest hospital, and medical repatriation pays for flying you to your home country.

» Learn more: Can I get travel insurance for pre-existing medical conditions?

24-hour assistance

This service is included with many package plans. The insurer provides a 24-hour hotline that you can call when you need help, such as booking a flight after a missed connection, finding lost luggage, or locating a doctor or lawyer.

Generally, travel insurance companies do not cover sports or any activity that can be deemed risky. If you’re thinking of incorporating adventurous activities into your vacation, choose a plan that includes adventure sports coverage.

Most travel insurers cover a wide array of services, but the specific options vary. Some plans include concierge services, providing help with restaurant referrals, tee time reservations and more. Many services also offer information before the trip, such as required vaccinations. The only way to know what’s included is to read the policy.

» Learn more: Should you insure your cruise?

Accidental death and dismemberment insurance

This coverage pays a lump sum to your beneficiary, such as a family member, if you die in an accident while on the trip. Accidental death and dismemberment insurance policies also pay a portion of the sum to you if you lose a hand, foot, limb, eyesight, speech or hearing. Some plans apply only to accidental death in a plane.

This coverage may be duplicative if you already have sufficient life insurance, which pays out whether you die in an accident or from an illness. You may also already have accidental death and dismemberment insurance through work, so it's best to check your policies to ensure you’re not overpaying.

Rental car coverage

Rental car insurance pays for repairing your rental car if it’s damaged in a wreck, by vandals or in a natural disaster. The coverage doesn't include liability insurance, which pays for damage to other vehicles or for the medical treatment of others if you cause an accident and are held responsible.

Ask your car insurance company whether your policy will cover you when renting cars on the trip. U.S. car insurance policies generally don’t cover you when driving in other countries, except Canada.

Car insurance requirements are complex because they vary among countries. You can usually purchase liability insurance from the rental car company. Learn about car insurance requirements by searching for auto insurance by country on the U.S. Embassy website .

A note about single vs. long-term policies

Single trip insurance plans are a great option for those going on a single trip for a specific length of time (e.g., a two-week vacation) and then returning home. The price of the policy is usually determined by the cost of the trip.

Long-term travel policies cover you for multiple trips, but there are limitations to how long you can be away from home, if you can return home during your travels and how many trips you can take. In addition, trip cancellation and interruption coverage is either not offered or capped at a dollar amount that can be significantly below the total cost of all the trips taken during the covered period.

Long-term travel insurance plans — often called 'multi-trip' or 'annual travel insurance' — are a suitable option for those who travel often and are satisfied with the amount of trip cancellation coverage for all the trips they take over the duration of the policy.

» Learn more: How annual (multi-trip) travel insurance works

Below, we include how to obtain travel insurance, along with the pros and cons of each option.

Some credit cards offer trip cancellation and rental car insurance if you use the card to book the trip or car.

When you book a trip with your credit card, depending on the card you use, you may already receive trip cancellation and interruption coverage.

Keep these tips in mind when you’re considering a trip insurance policy.

Evaluate the financial risks you face when traveling. Can you bear those costs yourself, or do you want insurance?

Examine what coverage you already have: Does your credit card offer travel insurance? Do you have renters or homeowners insurance to cover belongings? What is the deductible? Will your health plan cover you in all the locations where you travel?

Get quotes for trip insurance online. Choose a package of the benefits you need and compare prices for similar coverage among carriers.

Narrow your choices and then read the policy fine print to understand what’s covered, what’s excluded and the limits on coverage. You may find that the lowest-priced policy is too restrictive and that paying a little more gets you the coverage you need. Or you might find that the cheapest, most basic policy fits the bill.

There are a few scenarios when spending extra on travel insurance doesn't really make sense, like:

You booked flexible airline tickets.

Your hotel room has a good cancellation policy.

It's already included in your credit card.

You haven't booked any nonrefundable activities.

» Learn more: When you don't need travel insurance

Yes, especially for nonrefundable trips and travel during the COVID-era. Whether you purchase a comprehensive travel insurance policy or have travel insurance from your credit card, you shouldn't travel without having some sort of travel protection in place to safeguard you and your trip. Travel insurance can protect you in case of an unexpected emergency such as a canceled flight due to weather, a medical event that requires hospitalization, lost luggage and more.

There are many good travel insurance policies out there and a policy that may be great for you may not be good for someone else. Selecting the best plan depends on what coverage you would like and your trip details.

For example, World Nomads offers a comprehensive travel insurance policy that has excellent coverage for adventure sports. Allianz provides coverage for trips of varying lengths of time through its single trip plans and multi-trip plans. Some providers offer add-on options like Cancel For Any Reason travel insurance. If you’re not sure which plan to go with, consider looking at trip insurance comparison sites like Squaremouth or Insuremytrip.

Yes, you can. However, it's better to purchase it sooner rather than later, ideally right after booking your trip because the benefits begin as soon as you purchase a policy.

Let’s say you’re going on a trip in a month and a week before departure, you fall and break your leg. If you’ve purchased a travel insurance policy, you can use your trip cancellation benefits to get your nonrefundable deposit back.

Most comprehensive travel insurance plans offer trip cancellation, trip interruption, emergency medical and dental, medical evacuation, trip delay and lost luggage coverage. Many plans offer COVID coverage, but you’ll always want to check to ensure that the policy you choose provides that benefit if you’re traveling during these times. Some plans may also allow you to add features like Cancel For Any Reason travel insurance.

It depends which credit card you have. Premium travel cards like the Chase Sapphire Reserve® and The Platinum Card® from American Express offer travel insurance benefits if you book a trip using your card or points.

However, the coverage provided by the credit cards is usually lower than if you purchased a standalone policy. Review the travel insurance benefits on your credit card and check that the limits are adequate before foregoing from purchasing a separate plan.

Unpredictability is one of the mind-opening joys of travel, but travel insurance should contain no surprises. The time you spend to understand your options will be well worth the peace of mind as you embark on your next adventure.

Whether you’re seeking a single or a long-term policy, each travel insurance option offers different strengths and weaknesses. Choosing the right policy depends on your trip needs, your budget and how important various benefits are to you.

Tangerine Savings Account Review 2024

Published: Jul 23, 2024, 12:50pm

Tangerine’s Savings Account is great for growing your money without paying fees or service charges. Its 6% promotional rate and 0.60% base interest rate are on par with big banks. However, its interest rate falls short of other online banks like EQ Bank and Motusbank, which offer up to 4% interest on savings accounts.

If you’re just looking for a place to tuck money away for a few months, a Tangerine savings account will do the trick. But to maximize your returns or for long-term savings, you may want to consider another online bank or a high-interest savings account .

Her $5,500 infirmary bill was higher than the cruise itself: How she got it covered

Portrait of Kathleen Wong

  • Travel insurance is a must for cruises, as medical bills can be high.
  • Even a low level of travel insurance can cover medical bills from your ship.
  • If you opt for a comprehensive trip policy, you’ll be fully covered for trip cancellation plus medical expenses.

After taking a Caribbean cruise with her mother last year, Megan Ayscue didn’t think she’d end up with a medical bill that would cost more than the cruise itself.

The North Carolina-based traveler and her mother boarded the Norwegian Pearl in November to visit the Dominican Republic, Curaçao and other island destinations. The two were enjoying the trip until Ayscue went snorkeling in the Dominican Republic a few days in and got water stuck in her ear.

At first, she went to an infirmary in St. Thomas in the U.S. Virgin Islands, but the problem wasn’t resolved. Thankfully, her medical insurance covered the visit. Back on board, Ayscue went to the ship’s infirmary, where she was given oral antibiotics, Tylenol and ear drops. Her ear still hurt, so she went back to the infirmary the next day while the ship was at sea and was diagnosed with a bacterial infection that was spreading to her face.

What happens if you get sick or injured (or bitten by a monkey) on a cruise ship

“My ear had completely swelled shut. I could not hear out of my left ear. It was so painful, and I couldn’t feel the side of my face,” she said. The infection had spread into her lymph nodes, numbing the left side of her face.

Learn more: Best travel insurance

Ayscue received an IV infusion of steroids, anti-inflammatory medicine, antibiotics and anti-nausea medicine. The doctors told her to return the next day for another infusion. Ayscue said her experience with the onboard infirmary was positive and healed her infection, but she left with a bill of $5,528.29. Since Ayscue didn’t have the money at the time, her mother put it on her credit card.

Back home, Ayscue waited six months to hear that her insurer denied covering her medical expenses from the cruise. Her parents had to shift money around to cover Ayscue’s medical bill, and because her mother had booked the cruise on the same credit card, struggled to make her monthly payments.

Norwegian Cruise Line told USA TODAY that “we strongly encourage guests to file a claim with their health insurance provider post-cruise.”

There was, however, one saving grace. Thankfully, the family had purchased travel insurance for the cruise because Ayscue’s mother had experienced a heart attack a few years ago. That insurance, which cost about $300, ended up covering every cent of the medical bill.

“It ended up basically saving me and my parents from a financial cliff,” she said.

Unfortunately, Ayscue’s experience is not unusual, and a hefty medical bill on cruise ships can be expected, even for typical medical problems that warrant a little medical attention, such as seasickness or infections.

“It’s unfortunately extremely uncommon,” said Jenna Hummer, public relations director at travel insurance platform Squaremouth. “Our highest recommendation for medical coverage is always for cruises.”

Here’s everything you need to know about travel insurance and cruising.

Why do I need travel insurance for my cruise?

For starters, cruise ships are nearly always out-of-network from your typical medical insurance. “It’s not like you’ll have a co-pay, no, you’ll probably have to pay out-of-network costs and have an astronomically high bill if you break your ankle,” Hummer said.

“The thing about cruising is if you get sick on the boat, you obviously have limited resources, so those resources cost more. It’s like dining on top of a mountain or an island − it’s just harder to get supplies, so it can cost more.”

Even a low level of travel insurance can cover medical bills from your ship, but it also goes far beyond that − for example, if you need medical care in a foreign country or to return home early. Even if you port in a U.S. territory and go to a hospital there, it’s likely that visit will be out-of-network for your insurance as well.

Travelers prone to getting seasick or planning on a “high-risk activity” like jet skiing or scuba diving should also consider travel insurance for that extra protection if things go south.

What does travel insurance cover on a cruise?

It depends on what option you purchase. Emergency medical travel insurance will be your cheapest option at around $50. That is, unless you’re considered to be at a higher risk of needing medical care − for example, if you’re 65 years and older, or going to a destination that’s considered high-risk or harbors communicable diseases.

“By purchasing a travel insurance policy with emergency medical and emergency medical transportation benefits, cruisers can be reimbursed for the cost of emergency medical care up to their policy limit, whether they’re seeking care directly on the cruise ship or at their port of call,” said Daniel Durazo, director of external communications at Allianz Partners USA, which allows people to compare travel insurances.

If you opt for a comprehensive trip policy – which does cost more, 5% to 10% of your trip – you’ll be fully covered for trip cancellation plus medical expenses. “You’ll have 100% of your trip costs covered, but you’ll have options for how much medical coverage you want, like $10,000 or up to $1 million for medical evacuation coverage,” Hummer said. (A medical evacuation can cost tens of thousands of dollars.)

“It’s not a lot of money to insure yourself from a medical perspective,” she said.

“It’s better we spent those $300 for peace of mind and then it actually came in handy,” Ayscue said.

But if you’re intoxicated while visiting the infirmary, it’s possible your claim for travel insurance will be denied, Hummer added. So be careful with drinking. Pregnancy complications are also not typically included, although if you feel seasickness and are also pregnant, that will be covered.

For what it’s worth, travel insurance that’s more expensive doesn’t necessarily mean it’s better or covers more, so shop around and compare what’s included, Hummer said.

Can I buy travel insurance through my cruise line?

Technically you can, as most cruise lines offer some type of insurance, but it won’t be the best coverage. “Usually, they have very specific exclusions to keep an eye out for, like, they’ll only refund you a small portion of your trip if you get sick and there’s a very small timeline,” Hummer said. Basically, if you want to buy your cruise line’s insurance, read the fine print carefully.

When should I get travel insurance for my cruise?

For the most part, the earlier you get travel insurance, the more coverage you get. However, factors such as where you depart and the time of year also play a role.

“If you’re flying into Miami to board a cruise ship and it’s the middle of hurricane season, buy your travel insurance today,” Hummer said. “Alaska probably hasn’t seen a hurricane in forever, so it’s probably OK (to wait.)”

Buying travel insurance the day before your trip doesn’t necessarily affect the cost of insurance as it does the cost of flights, just what’s covered. If a storm is predicted before you purchase insurance, then that probably won't be covered by the time you do.

“Buying travel insurance as soon as you book your cruise is a smart move,” Durazo said.

CrowdStrike's terms and conditions say most customers would just get a refund due to the massive outage, cybersecurity lawyer says

  • CrowdStrike's botched update caused flight disruptions, 911 call issues, and medical record blocks.
  • CrowdStrike's terms cap liability to fees paid, limiting compensation for affected companies.
  • Unless you're a big company that negotiated other terms, you probably need to deal with cyber insurance.

Insider Today

The devastating outages from CrowdStrike's botched security update Friday grounded flights, glitched 911 call lines, and blocked patients from accessing their medical records.

But, according to the cybersecurity company's terms and conditions, CrowdStrike doesn't have to shell out anything more than a simple refund.

The terms for CrowdStrike's Falcon security software — which is used by companies and government agencies around the world — limit liability to "fees paid."

That means that if a company had a claim against CrowdStrike for the damage or lost revenue to its business, the most it could recover is just what it paid to CrowdStrike, according to Elizabeth Burgin Waller, the chair of the Cybersecurity & Data Privacy practice at Woods Rogers.

That means CrowdStrike users who signed the standard terms and conditions can't expect to get more than a refund from the company, Waller said.

"Even if they did cover that lost revenue or downtime, they limit the recovery against CrowdStrike to fees paid," Waller told Business Insider. "So whatever I paid for fees to CrowdStrike, that's what the limitation of liability would be."

Related stories

Bigger companies using CrowdStrike's software — like some of the airlines or hospital chains affected — may have negotiated different terms and conditions contracts with the cybersecurity company. Those contracts aren't public, and it's possible they contain terms that would hold CrowdStrike liable for more damages, Waller said.

"If you're a huge company, you might have been able to get some negotiation around that," she said.

A representative for CrowdStrike didn't immediately respond to Business Insider's request for comment about how it will enforce its terms and conditions.

To cover all the expenses being paid to deal with the CrowdStrike fallout — including hiring IT people to install another update that fixes the issue on Windows machines, lost employee productivity, fixing issues for customers, and possible legal expenses for publicly traded companies that need to file relevant securities reports for investors — most companies will have to turn to cyber insurers, Waller said.

According to Waller, most cyber insurance companies have policies that cover "contingent business interruption" or "dependent business interruption." Those allow companies to recover damages from insurers against third-party cybersecurity companies they depend on. CrowdStrike's Falcon software, which monitors threats on computers, could qualify.

"If I've got a big stop sign in front of me — terms and conditions against CrowdStrike — or if I can only get a refund, then I need to go look to my own cyber insurance policy," Waller said.

Many such policies cover only malicious events like hacking, Waller said.

"We've just got a software glitch. So I think we're going to see lawsuits filed against cyber insurance carriers for years to come, I imagine, on this outage," Waller said. "This is a pretty big, from a cyber insurance standpoint, I think this is also going to spawn a lot of litigation about what's covered and what is intended under these different policies."

CrowdStrike can expect SEC scrutiny

As for CrowdStrike, it can expect lawsuits from shareholders, customers who want to try to obtain more damages, and likely an investigation from the Securities and Exchange Commission, Waller said.

The company, which is publicly traded, will have to file an 8-K report in the next few days with the SEC that lays out what went wrong with the Falcon update.

By a strange coincidence, the CrowdStrike disaster came a day after a major ruling by a federal judge in Manhattan in favor of SolarWinds — a technology security company that was breached in a 2020 Russian cyberespionage campaign — in a lawsuit brought by the SEC.

The SEC alleged SolarWinds didn't sufficiently update investors and the public about the massive scope of the fallout from the Russian hack. But US District Judge Paul Engelmayer ruled Thursday that the company didn't need to provide the "maximum specificity" the SEC demanded.

That ruling gives some breathing room to CrowdStrike, a $73 billion company, which has a responsibility to update investors and the public about what happened — but now needs to worry less about just how much detail it provides.

"You need to convey the severity of what is happening, but we don't need to be really concerned about the nitty gritty details or what we don't know," Waller said.
