Article 1 Nature and Scope of Obligations

1.  Members shall give effect to the provisions of this Agreement. Members may, but shall not be obliged to, implement in their law more extensive protection than is required by this Agreement, provided that such protection does not contravene the provisions of this Agreement. Members shall be free to determine the appropriate method of implementing the provisions of this Agreement within their own legal system and practice.

2.  For the purposes of this Agreement, the term “intellectual property” refers to all categories of intellectual property that are the subject of Sections 1 through 7 of Part II.

3.  Members shall accord the treatment provided for in this Agreement to the nationals of other Members.  (1) In respect of the relevant intellectual property right, the nationals of other Members shall be understood as those natural or legal persons that would meet the criteria for eligibility for protection provided for in the Paris Convention (1967), the Berne Convention (1971), the Rome Convention and the Treaty on Intellectual Property in Respect of Integrated Circuits, were all Members of the WTO members of those conventions.  (2) Any Member availing itself of the possibilities provided in paragraph 3 of Article 5 or paragraph 2 of Article 6 of the Rome Convention shall make a notification as foreseen in those provisions to the Council for Trade-Related Aspects of Intellectual Property Rights (the “Council for TRIPS”).

Article 2 Intellectual Property Conventions

1.  In respect of Parts II, III and IV of this Agreement, Members shall comply with Articles 1 through 12, and Article 19, of the Paris Convention (1967).

2.  Nothing in Parts I to IV of this Agreement shall derogate from existing obligations that Members may have to each other under the Paris Convention, the Berne Convention, the Rome Convention and the Treaty on Intellectual Property in Respect of Integrated Circuits.

Article 3 National Treatment

1.  Each Member shall accord to the nationals of other Members treatment no less favourable than that it accords to its own nationals with regard to the protection  (3) of intellectual property, subject to the exceptions already provided in, respectively, the Paris Convention (1967), the Berne Convention (1971), the Rome Convention or the Treaty on Intellectual Property in Respect of Integrated Circuits. In respect of performers, producers of phonograms and broadcasting organizations, this obligation only applies in respect of the rights provided under this Agreement. Any Member availing itself of the possibilities provided in Article 6 of the Berne Convention (1971) or paragraph 1(b) of Article 16 of the Rome Convention shall make a notification as foreseen in those provisions to the Council for TRIPS.

2.  Members may avail themselves of the exceptions permitted under paragraph 1 in relation to judicial and administrative procedures, including the designation of an address for service or the appointment of an agent within the jurisdiction of a Member, only where such exceptions are necessary to secure compliance with laws and regulations which are not inconsistent with the provisions of this Agreement and where such practices are not applied in a manner which would constitute a disguised restriction on trade.

Article 4 Most-Favoured-Nation Treatment

  With regard to the protection of intellectual property, any advantage, favour, privilege or immunity granted by a Member to the nationals of any other country shall be accorded immediately and unconditionally to the nationals of all other Members. Exempted from this obligation are any advantage, favour, privilege or immunity accorded by a Member:

(a)  deriving from international agreements on judicial assistance or law enforcement of a general nature and not particularly confined to the protection of intellectual property;  

(b)  granted in accordance with the provisions of the Berne Convention (1971) or the Rome Convention authorizing that the treatment accorded be a function not of national treatment but of the treatment accorded in another country;  

(c)  in respect of the rights of performers, producers of phonograms and broadcasting organizations not provided under this Agreement;  

(d)  deriving from international agreements related to the protection of intellectual property which entered into force prior to the entry into force of the WTO Agreement, provided that such agreements are notified to the Council for TRIPS and do not constitute an arbitrary or unjustifiable discrimination against nationals of other Members.

Article 5 Multilateral Agreements on Acquisition or Maintenance of Protection

  The obligations under Articles 3 and 4 do not apply to procedures provided in multilateral agreements concluded under the auspices of WIPO relating to the acquisition or maintenance of intellectual property rights.

Article 6 Exhaustion

  For the purposes of dispute settlement under this Agreement, subject to the provisions of Articles 3 and 4 nothing in this Agreement shall be used to address the issue of the exhaustion of intellectual property rights.

Article 7 Objectives

  The protection and enforcement of intellectual property rights should contribute to the promotion of technological innovation and to the transfer and dissemination of technology, to the mutual advantage of producers and users of technological knowledge and in a manner conducive to social and economic welfare, and to a balance of rights and obligations.

Article 8 Principles

1.  Members may, in formulating or amending their laws and regulations, adopt measures necessary to protect public health and nutrition, and to promote the public interest in sectors of vital importance to their socio-economic and technological development, provided that such measures are consistent with the provisions of this Agreement.

2.  Appropriate measures, provided that they are consistent with the provisions of this Agreement, may be needed to prevent the abuse of intellectual property rights by right holders or the resort to practices which unreasonably restrain trade or adversely affect the international transfer of technology.

The WTO TRIPS agreement adopts substantive protections from existing multinational agreements on intellectual property rights. It bundles existing intellectual property rights into a package governed by generally applicable trade-related principles (most-favored-nation treatment, national treatment and transparency) and by a Council for Trade-Related Aspects of Intellectual Property Rights (“Council for TRIPS”).

Copyrights. The TRIPS agreement extends and clarifies rights under the Berne Convention on copyrights. It supports global services, particularly data processing, through clarifying that copyright protection shall apply in member states to:

Computer programs, whether in source or object code, which are protected as literary works under the Berne Convention (1971), and, “Compilations of data or other material, whether in machine readable or other form, which by reason of the selection or arrangement of their contents constitute intellectual creations.”  As a limitation, “[s]uch protection, which shall not extend to the data or material itself, shall be without prejudice to any copyright subsisting in the data or material itself.”  TRIPS, Art. 10.

Copyright protection shall extend to expressions and not to ideas, procedures, methods of operation or mathematical concepts as such.

Copyright Exceptions. The national member states may not Members adopt limitations or exceptions to exclusive rights for certain special cases unless such limitations or exceptions “do not conflict with a normal exploitation of the work and do not unreasonably prejudice the legitimate interests of the right holder.” TRIPS, Art. 13. In effect, national limitations on the rights of foreign copyright owners must not exceed regulation of “normal” exploitation and the “legitimate interests of the right holder.”

Trademarks. Trademark rights in global services do not have significant value. Enterprise customers want to preserve their own trademarks and not promote foreign service providers’ use of confusing or similar marks. The trademark provisions of the TRIPS agreement is thus of limited value for promoting the adoption of services marks by global service providers. It does protect the interests of enterprise customers, who should be vigilant to register their marks in TRIPS member states in order to acquire “the exclusive right to prevent all third parties not having the owner’s consent from using in the course of trade identical or similar signs for goods or services which are identical or similar to those in respect of which the trademark is registered where such use would result in a likelihood of confusion.” TRIPS, Art. 16.

Industrial Designs. The TRIPS agreement ensures protection of “independently created industrial designs that are new or original,” but member states can decree “that designs are not new or original if they do not significantly differ from known designs or combinations of known design features.” Also, such protection may be denied for “designs dictated essentially by technical or functional considerations.” TRIPS, Art. 25. Except for contract manufacturing services the consumer goods, such provisions are of limited benefit for global services.

Patents. The TRIPS agreement encourages foreign investors to establish local factories to manufacture goods under patents. Subject to certain exceptions, it requires that “patents shall be available for any inventions, whether products or processes, in all fields of technology, provided that they are new, involve an inventive step and are capable of industrial application.” [Footnote: “For the purposes of this Article, the terms “inventive step” and “capable of industrial application” may be deemed by a Member to be synonymous with the terms “non-obvious” and “useful” respectively.” This definition was designed to accommodate U.S. patent law.] TRIPS, Art. 27(1).

Exceptions in Patent Rights. TRIPS allows exceptions where member states deem it necessary to “protect ordre public or morality, including to protect human, animal or plant life or health or to avoid serious prejudice to the environment, provided that such exclusion is not made merely because the exploitation is prohibited by their law.” TRIPS, Art. 27(2). Such exceptions expose foreign companies to loss of legal protections if they rely upon local patents to ensure that local competitors do not use their processes competitively. Such considerations are important in contract manufacturing but not necessarily in outsourcing of business services.

Omissions from Patent Protection. The TRIPS agreement does not require a member state to adopt a “business method patent,” such as patents issued in the United States. Enterprise customers must therefore ensure that any proprietary business methods are protected contractually and otherwise by local law on trade secrets. Service providers likewise need to pay attention to this omission as they develop their own trade secrets or improved business processes from general skill and knowledge not at the customer’s expense. Intellectual property provisions thus require a contractual allocation, and parties cannot simply rely on patent law for their protections. The protection of business method patents in one country and the lack of protection in another country creates an incentive not to seek such patents of they provide significant competitive advantage in an enterprise’s core business. As a result, TRIPS may merely encourage more use of trade secrets and contractual allocations of rights and remedies in “business process” design and management.

Confidential Information (“Undisclosed” Information”). In the provisions governing “confidential information,” the TRIPS agreement is most valuable in fostering global services, particularly business process outsourcing (“BPO”), information technology outsourcing (“ITO”) and the outsourcing of specialized business operations ranging from mortgage and credit card processing to market research, product research and development, product design services, pharmaceutical design, testing and manufacturing services and other specialized services. Article 39 states:

In the course of ensuring effective protection against unfair competition as provided in Article 10 bis of the Paris Convention (1967), Members shall protect undisclosed information in accordance with paragraph 2 and data submitted to governments or governmental agencies in accordance with paragraph 3. Natural and legal persons shall have the possibility of preventing information lawfully within their control from being disclosed to, acquired by, or used by others without their consent in a manner contrary to honest commercial practices 1   so long as such information: (a)  is is secret in the sense that it is not, as a body or in the precise configuration and assembly of its components, generally known among or readily accessible to persons within the circles that normally deal with the kind of information in question; (b) has commercial value because it is secret; and (c) has been subject to reasonable steps under the circumstances, by the person lawfully in control of the information, to keep it secret. Members, when requiring, as a condition of approving the marketing of pharmaceutical or of agricultural chemical products which utilize new chemical entities, the submission of undisclosed test or other data, the origination of which involves a considerable effort, shall protect such data against unfair commercial use. In addition, Members shall protect such data against disclosure, except where necessary to protect the public, or unless steps are taken to ensure that the data are protected against unfair commercial use.

When drafting international international BPO agreements, consideration must be given to appropriate protections of trade secrets of each party. The TRIPS agreement offers a framework for the design, negotiation and enforcement of such outsourcing agreements.

Unfair Licensing Practices. TRIPS targets the liberalization of licensing practices but reserves regulatory authority for member states to specify

“in their legislation licensing practices or conditions that may in particular cases constitute an abuse of intellectual property rights having an adverse effect on competition in the relevant market. As provided above, a Member may adopt, consistently with the other provisions of this Agreement, appropriate measures to prevent or control such practices, which may include for example exclusive grantback conditions, conditions preventing challenges to validity and coercive package licensing, in the light of the relevant laws and regulations of that Member.” TRIPS, Art. 40(2)

Accordingly, grants of licensed rights to a service provider (or to an enterprise customer of BPO global services) may run afoul of local laws. Both customer and service provider have an interest in ensuring that local laws are not designed or interpreted to prevent reasonable licensing practices necessary to implement ITO or BPO global services.

Enforcement. The TRIPS agreement requires member states to adopt civil and criminal laws to protect intellectual property rights of foreigners of other member states. Enforcement remedies may be slow in some countries, so enterprise customers will want to investigate the legal system in every country where they have BPO services performed.

Exceptions to TRIPS.

Exceptions Generally. As with other WTO agreements, several exceptions apply to the general principles promoting liberalization of trade in services and goods.

Exceptions to National Treatment. The principle of “national treatment” is thus subject to the exceptions already provided in, respectively, the Paris Convention (1967), the Berne Convention (1971), the Rome Convention or the Treaty on Intellectual Property in Respect of Integrated Circuits. TRIPS, Art. III(1).

Exceptions to Most-Favored-Nation Treatment. MFN treatment does not apply in several cases involving “any advantage, favour, privilege or immunity accorded by a Member:

(a)          deriving from international agreements on judicial assistance or law enforcement of a general nature and not particularly confined to the protection of intellectual property;

(b)         granted in accordance with the provisions of the Berne Convention (1971) or the Rome Convention authorizing that the treatment accorded be a function not of national treatment but of the treatment accorded in another country;

(c)         in respect of the rights of performers, producers of phonograms and broadcasting organizations not provided under this Agreement;

(d)        deriving from international agreements related to the protection of intellectual property which entered into force prior to the entry into force of the WTO Agreement, provided that such agreements are notified to the Council for TRIPS and do not constitute an arbitrary or unjustifiable discrimination against nationals of other Members.” TRIPS, Art. 4.

Exceptions Exceptions under WIPO Agreements. In addition, TRIPS principles of national treatment and MFN rights do not apply under multilateral agreements separately concluded under the auspices of WIPO relating to the acquisition or maintenance of intellectual property rights. In short, TRIPS leaves to WIPO the right to develop additional IPR conventions.

Exceptions under Public Policies. Similar to the GATS exceptions, TRIPS allows many exceptions to its protections, including measures

  • “necessary to protect public health and nutrition, and to promote the public interest in sectors of vital importance to their socio-economic and technological development, provided that such measures are consistent with the provisions of this Agreement; or
  • “… to prevent the abuse of intellectual property rights by right holders or the resort to practices which unreasonably restrain trade or adversely affect the international transfer of technology.” TRIPS, Art. 8.

How to plan your next art trip the right way

How to plan your next art trip the right way

Summer is here, and although this summer is going to be different, it’s still time for some traveling. I am lucky enough to live in Europe, where traveling is permitted (almost) everywhere, despite Coronavirus and a second wave of new cases across the continent. This is why, fingers crossing, I will be leaving for Switzerland soon. 

I’ll be doing what I call the “lake and art” road trip, starting from Como and driving around Switzerland. In fact, when this article will be published, I’ll be exploring a nice kunsthalle or bathing in a lake. Check Artsy Travels Instagram for live updates! 

Anyway, the point is, it’s time to plan a trip, and I figured you might want to know how I do it. That is why I decided to put together this short guide on how to plan your next art trip. 

1 – Choose a destination

This sounds like the easiest part, but in fact, it is not. Some destinations seem more appealing than others, some are just too far away, or too expensive. And then again, some are close and easy to reach, but you don’t really feel like going there. 

When choosing a destination, take into consideration how far you can go, how long you can stay, and if the destination fits you. For example, for the longest time I have dreamt of traveling to China, but I haven’t had the chance yet. China is big, full of things to do and see, and it would take me a lot of time to actually visit it. Which is why I haven’t yet: I’d rather wait, than just travel there for 7 or 10 days trying to squeeze in as many things as possible. 

On the contrary, there are places which I know are extremely beautiful, and that I will maybe visit one day, but they are not my top priority right now. Like beautiful Caribbean beaches, or ski resorts on the Alps. I know I would enjoy a short vacation there, but I also know that I would probably get bored after a few days, so for now I am not considering them. 

If you need to choose and have no clue on where you should go, try this method. First analyze the closest destinations around you, places you’ve never been before and you would like to visit. Then start considering places further and further away, until you find a balance between your budget, the time you can spend traveling and your own curiosity.

2 – Do some research – General info

Once you have narrowed your list down to 3 or 4 places, start doing some research. At this stage, you want to find out on a general level what each destination has to offer, in terms of places to visit, attractions, culture, food, shopping, outdoor activities, festivals, and so on. Start on a very general level, because it is easier to find information. 

Remember, Google is your best friend in this situation. Chances are, wherever you are traveling, someone has been there before, and they might have written something about their trip. Or you could find photos and videos. The point is, get a written and a visual idea of the places you intend to visit. It will help you picture yourself there, understanding whether it is the right destination for you or not. 

3 – Focus on what you like 

Once you have a general picture of the place you are about to visit, dig a little deeper. It is now time to find out what these places really have to offer. And since we are talking about art trips, I suppose you will be looking for museums, galleries, exhibitions, and art-related attractions. 

As I told you, there are 3 online resources I always check before planning a trip, you can find more information in this article . But you can also use Pinterest or Instagram, to search for hashtags and pin things you find interesting. 

Another resource I really love using is Culture Trip . It is an online platform where you can find any sort of information, mostly written by locals and experts, basically on every place on Planet Earth. They have articles on museums, galleries, but also food, shopping, itineraries, beautiful castles, churches or temples, archeological sites, music festivals, and so on. For anything you want to know about a destination, they probably have an article. You can use it as a starting point to decide where to go, how long you should stay, and what route you should follow.

Remember, every traveler is different and every trip should reflect the peculiarities of the traveler. Use the information you find to plan your own trip, you shouldn’t be forced to stick to what other people say. You are free to choose, that is the beauty of traveling. Embrace your freedom and plan whatever you feel like doing.

4 – Put it on a map

At this point, you should have a relatively clear idea of what you would like to do and where you would like to go. You have a destination, maybe a set of places you plan to visit – neighborhoods, cities, smaller villages, single attractions, museums, galleries, etc. – but you still don’t know how to organize all these information.

My advice is, put everything on a map. I usually use Google My Maps , but you can find a lot of different options online. There are websites and apps, but if you are more of an artsy type of person, you can draw your own map. The important thing is, put everything down and see where all those things are located. It’ll make it easier to visualize where places are, what is close to what else, which itinerary you can follow, how you can plan each day visiting a different area of a city or a country. 

Pinning everything you want to visit on a map is a great help when it comes to making things clear on your mind. It helps you visualize your trip, it gives you an idea of how long you should stay in each place, and once you are there it helps you getting around. Try to cross your own map with a general list of attractions and things to do in a specific place, so you can mix and match and create your own perfect itinerary.

5 – Ask a local  

Asking a local is never been easier. First of all, if you are reading this blog post, you probably speak English, and therefore you can communicate with a lot of people around the globe. Reach out to people, ask for directions, sit in a bar, and talk to some local old men. They will have a lot of stories for you, they will point you towards the best places to eat, the best neighborhoods to go shopping or the best things to visit. 

If you want to ask a local before actually leaving, I recommend you check Airbnb experiences. I have used Airbnb to find accommodations, but also to book amazing tours. Airbnb offers you the possibility to connect with local experts that will show you a part of their city, the one they know best. I used it in Tokyo, where I met a curator that brought me on a gallery tour, and I did the same in New York, before moving there. I met two art advisors, and together we visited a few galleries in the Lower East Side area. This experience was so good, that one year later I was moving to NYC to actually work in one of these galleries. 

My point is, no matter how long you stay in a place, you will never be able to get to know it as much as someone who lives there. Find someone who is interested in what you like or works in your same field, and ask. People are happy to share their knowledge, especially if they love their city and you will discover places you wouldn’t have the chance to see otherwise. 

6 – Check the important details

Almost there, by now you should have a destination, a list of things to do and places to see in said destination, a map with all these things pinned, an itinerary with some recommendations by some local friend. And now comes the most important part. 

Check the details! Check when the museums are closed, check what time they open, and if they have longer opening hours during the weekend. Verify if they have exhibitions on view or if they are closed for installation. Make sure that the day you are planning to go is a regular day and not a bank holiday. Check if they have free nights or any special event. 

Check all the boring things and the exciting ones. I am telling you because I have done all these mistakes time and time again, but I am finally learning. Before you book your hotels or your flights, check everything. You don’t want to book a day trip from Madrid to Bilbao on the only day the Guggenheim Museum is closed.

7 – Get lost

9+ Best Travel Art Supplies for Painting Artists Who Travel

One of the perks of painting is that all of the necessary materials are fairly portable. This article will guide you through which travel art supplies are the easiest to pack and take with you.

We are lucky in this day and age to be able to carry our paints in small paint tubes and have easels that are light and foldable. However, there are a LOT of different materials out there and it can be hard to know what exactly you need to paint and travel. I will break down exactly what you will need, so that you can easily be a traveling artist, painting on the go!

Painting Surfaces Best for Travel

This is one of the more important of the travel art supplies you’ll need to remember to take with you. As wherever you paint you will always need something to paint on.

I recommend using loose gessoed canvas that can be rolled up. Boards will take up more space than stretched canvas. Not to mention you have to be a little more careful not to puncture or damage stretch canvases!

You can gesso your own canvas or purchase it already primed and ready to paint on! When you are ready to start your painting, you will simply cut out a size that is appropriate for your project. Then attach the piece of canvas to a hard board with some masking tape. This hard board will act as a support for all of your paintings on your journey. You will be able to use both sides if you wish to do multiple paintings at a time! I do this often 😉

Art Supplies for Storing Paintings and Canvas

To transport your canvas I recommend to roll it up and store it safely inside a mailing tube. This provides excellent protection for your painting surface and keeps it from getting any creases.

In addition, I recommend for you to use the mailing tube to store your completed paintings on your travels ( once they are dry ). Again this is a wonderful way to protect your work from getting any folds or creases. When traveling we often accidentally drop things or stack things on top of one another. Therefore storing your work in a mailing tube alleviates a lot of worry about any damage that may incur to your work!

✨ A quick tip about rolling up paintings – keep the painted side on the outside! I know this sounds odd but it is the best way to take care of your paintings while rolling them up. Rolling oil paintings inwards can cause them to chip or flake which will become visible when laid out flat again.

Travel Art Carrying Case

What if your paintings are still wet and you need to continue your travels? Enter the wet panel art carrying case ! You can purchase one or make your own. They allow you to store wet painting safely inside a box in such a way so that it won’t touch anything else. I personally keep my painting taped down to a board to allow for me to place my painting safely inside a carrier if I need to do so.

Art Supplies to Speed up Drying Time

If you are using oil paints and would rather not have to deal with wet paintings while traveling. There are specific travel art supplies that can help speed up the drying time.

Liquin for traveling artists

Liquin will help a great deal to speed up the drying time! Using just a little will go a long way. Add it to your paint at times when you would normally use linseed oil to thin out your paint.

Whenever I use Liquin in a painting, I take out a small amount of it from the jar using a palette knife and place a little pile of it onto my palette. This way it is easy for me to add it as needed while I mix my oil paints .

Lightweight Travel Easels

An easel can be a little bit of a headache for artists who are traveling, as it is most likely the largest item out of all your travel art supplies. However, there are some great travel easel options out there for every budget!

Pochade boxes for travelers

A pochade box is one of the most popular easels for plein air painters and traveling artists. They are also quite historical as they came into popularity in the 19th century when artists started to paint out of doors. Pochade boxes tend to be small and are highly portable as you can store not just your materials inside them but also your painting. You can purchase one or make your own out of a cigar box!

French easel travel supplies

I personally use a French easel when I travel as well as in my studio. So, it is nice to be able to use the same easel that I always use when on the go. Similar to the pochade box, it allows you to store a lot of supplies inside the easel including your palette. It can be folded up smaller which makes it easy to carry and transport.

However, the downside to a French easel however is that it can be a bit heavier than other options, due to its wood construction. So, if you are looking for something particularly lightweight, this might not be the best option for you.

Tripod easel with palette box

The tripod easel and palette box can sometimes be a good alternative to the traditional French easel. The versions made out of aluminum can be lighter weight and less prone to breakage. In addition, this variety gives you a good distance between the painting and the palette – something missing with a pochade box.

A good camera tripod easel with a palette box can be a little pricey. However, if you are planning to do a lot of plein air painting or walking with your painting supplies. It is really worth it to get a lightweight easel, as your back will thank you! 🙂

Brushes and Brush Cleaner

For traveling I recommend the Guerilla ‘mighty mite brush washer’ . It is leak proof, you don’t have to worry about soiling things when traveling with with linseed oil or turpenoid. In addition, it works as a terrific brush cleaner that lasts a long time.

Palette cups

You could also use oil painting palette cups. These are small metal cups that you can clip onto your palette. They are not meant to be a brush cleaners however. So you can’t clean your brush in this as thoroughly as you could in a regular brush cleaner. However, these make for super useful travel art supplies. As they work great as receptacles to keep your linseed oil and or turpenoid in – when you need to use those in your painting.

Paints for Travel

Most paint tubes come in a large or small size – typically 37 ml or 150 ml size tubes. So, when traveling with your painting supplies it is best to use small sized tubes. As this will help a great deal with keeping the weight down.

If small sized paint tubes are still too heavy and you don’t need to take that much paint with you… Then you could purchase small containers to store your paint in. Just keep in mind, that the paint will dry quicker in such containers than if it remained in a tube!

So, if you are planning to travel and paint for just a few days then small containers work nicely. However, not if you will be on the go with your travel art supplies for a couple of weeks or longer. As the paint will likely dry out over that period time.

After traveling many times with oil paints – believe me when I say that you will appreciate knowing how to fly with oil paints!

I am not traveling very far but when I do travel I have a few art supplies! And I have taken a couple of trips to Yosemite National Park, and Big Sur, and even Lake Tahoe it was beautiful with so much to paint! I have a few travel watercolor sets! And I have gotten good at scouting out a spot with natural beauty as well as shade!

I have found that painting in different places does make you better at being able to scout good painting locations – and its wonderful when shade accompanies a good painting view 😉

Hi Elizabeth! I have been Plein Aire painting for years. Since I paint locally one of the best aids is my garden wagon. It collapses and stays in the car trunk ready to load up and head into nature filled up with all the painting supplies mentioned. It is better than using a backpack!

Hi Sandy! Oh that is a really good tip. What a great setup to be able to collapse it and keep it in your car. I completely agree – Carrying everything in a backpack can be quite exhausting as once you reach your destination you are a bit too tired to paint! 😉

The Four Season Private Jet

Time is luxury, and having it all means squat without the calendar space to enjoy it. For ultra-high-end travel operators, the search for lost time has led to demand for a product that may sound slightly down market: package itineraries.

“More and more, travelers are looking for immersive, personalized, and worry-free travel experiences,” says Marc Speichert, executive vice president and chief commercial officer at the Four Seasons .

There is, however, one massive difference between these package itineraries and the geriatric-themed bus tours of yore: They’re by private jet, yacht, and Bentley.

For years, the Four Seasons has offered a Private Jet Experience , which Speichert says is about creating “a seamless end-to-end journey with our legendary comfort, service, and amenities.”

In a similar vein, White Desert speeds up Antarctic exploration by replacing the multi-day southward cruise with a private jet, a luxury whip.

“Many of our clients are company owners or entrepreneurs with highly pressurized jobs,” says Mindy Roberts, the company’s CMO. “When it comes to leisure travel, they’ve said they enjoy that the decision-making has been taken away from them and they can completely relax and be on holiday.”

Another factor driving growth in ultra-luxury, pre-planned, package bookings is their ability to facilitate slow travel. Both the Four Seasons and White Desert offer tours lasting upwards of three weeks, leaving plenty of time to explore each stop thoroughly.

Kalindi Juneja, CEO of U.K. firm PoB Hotels , says its guests are increasingly opting for longer stays in fewer destinations—its longest curated itinerary is 12 days. The brand is “prioritizing depth over breadth in their exploration,” says Juneja. “‘Authenticity’ drives guests to explore off-the-beaten-path destinations, engage with local artisans, savor traditional cuisine, and participate in cultural activities unique to each location on their itinerary.”

Around the World in 24 Days

Four Seasons offer a wide range of itineraries using the private-jet service it launched in 2015, with eight tours taking place each year and varying between 13 and 24 nights in duration.

Travelers love flocking to Europe to relax and recuperate at one of its many beaches .

It's no wonder why. Europe's diverse coastline is full of natural beauty, from the turquoise waters of the Mediterranean to the rugged cliffs of the Atlantic coast. These beaches are set against the backdrop of charming coastal villages and host iconic European beach clubs (Aperol Spritz, anyone?).

To help travelers find the perfect beach for their next Euro-trip, U.K.-based travel insurance comparison site Quotezone ranked Europe's most popular beaches, considering factors such as sea and air temperature, calmness of the water, TripAdvisor reviews and average cost to visit the destination (including food, drink and an overnight stay). The beaches spanned beloved destinations like Greece, Spain and Italy but also included lesser known locales such as Slovenia.

"Anyone planning a vacation to Europe should be sure to visit these beauty spots featured in our index, especially our top three hidden gems Cyprus, Malta, and Slovenia," CEO and travel insurance expert at Quotezone, Greg Wilson, told USA TODAY in a statement.

10. Plage de Palombaggia in Corsica, France

Located in the Mediterranean Sea just south of mainland France, Corsica offers beaches comparable to the Caribbean with Plage de Palombaggia is one of the most popular beaches on the island. Think crystal-clear water, soft white sand and secluded coves. The beach scored the 10th spot on the ranking for is gentle waters and having over 3,300 five-star reviews. However, visiting the beach won't come cheap. Plage de Palombaggia is the most expensive beach on the ranking, costing €233 (about $259.73) for an overnight stay with food and drink.

9. Bournemouth Beach in Bournemouth, England

Tucked beneath cliffs, the sprawling Bournemouth Beach has been voted the top beach in the U.K. on TripAdvisor, offering rare warm waters for the country, a bustling pier and calm waters. Visiting the beach will be a bit costly for visitors – the beach is the second-most expensive on the index – clocking in at an average of €180 (about $200) for a one-day stay.

8. Playa de Maspalomas in Gran Canaria, Spain

Spain's Canary Islands are idyllic, offering diverse beaches made of black or golden sand. Playa de Maspalomas on the island of Gran Canaria is well-known for its lighthouse, rolling dunes and warm waters earned it a spot on QuoteZone's index. Surrounded by restaurants and hotels, visiting the beach will cost, on average, €151 (about $168).

7. Praia da Falesia in Algarve, Portugal

One of Portugal's most famous beaches, Praia da Falesia is worth the hype. The beach has an array of natural beauty on display – from sandstone cliffs to bright blue water – but also offers a lot to do. Visitors can check out the tide pools at low tide, swim or surf. Visitors can expect to pay around €137 (about $152) for a one-day stay.

6. La Pelosa Beach in Sardinia, Italy

Located on the second-largest island in the Mediterranean, Sardinia is a picturesque escape for travelers, and its beaches are no different. La Pelosa Beach's tranquil waters and white sands have made it so popular that you need to book your visit in advance, which will cost €3.50 (about $3.90). Staying near the beach is pricey, costing about €166 (about $185).

5. Zlatni Rat in Bol, Croatia

Translating to "Golden Horn," Zlatni Rat is a famous triangle-shaped beach on the Croatian island of Brac that extends into the ocean. As the tides and swells change, the beach also shapeshifts. Besides how stunning the beach is, it's also relatively inexpensive to visit, coming in as the second-least expensive beach locale on the index. For food, drink and a one-night stay, the average price is €96 (about $107).

4. Elafonissi Beach in Crete, Greece

Crete is beloved by travelers, and Elafonissi Beach is one of the Greek island's famous beaches. Depending on the season of your visit, you may encounter the iconic pink sand, but year-round, the beach is beautiful with calm azure waters. However, the beach isn't exactly tranquil, and gets quite crowded as the day goes on. To visit, the average cost is €184 (about $205).

3. Portoroz Beach in Portoroz, Slovenia

Nestled against the Adriatic Sea, Portoroz Beach is a gorgeous pebble beach fronting Portoroz's resort area, so you can take a break from the sun and stroll the promenade. The beach is also the cheapest on the index, costing €93 (about $103) on average for a one-day stay.

2. Mellieha Bay Beach in Mellieha, Malta

Not only is Mellieha a sheltered bay that provides gentle and warm waters, but it's also the largest sand beach in Malta, making it the perfect place for families. The beach scored high on the index for its warm temperatures and water. Visitors can rent sunbeds, swim, kayak and more. To visit, it will cost €117 (about $130) on average.

TSA readies for busiest Labor Day travel period on record, provides top travel tips to help airline passengers prepare

WASHINGTON — The Transportation Security Administration (TSA) is prepared to screen more than 17 million people during what is expected to be the busiest Labor Day travel period on record, which will run Thursday, August 29 through Wednesday, September 4. The peak travel day is projected to be August 30, when TSA expects to screen 2.86 million people.

Air travel volumes this summer are the highest the agency has seen in its history. The agency expects passenger volumes to be 8.5 percent higher than last year during this time, and has already screened 239.8 million people since Memorial Day weekend, which is an average of  2.7 million per day. The top ten busiest travel days in the agency’s history have all occurred this year since May 2024. The agency reached a new milestone on July 7, when Transportation Security Officers (TSOs) screened more than 3 million people in a single day.

“People are traveling more than ever this summer and TSA along with our airline and airport partners stand ready to close the busiest summer travel period on record during this upcoming Labor Day weekend,” said TSA Administrator David Pekoske. “I commend our vigilant workforce, from our TSOs on the front lines at airport security checkpoints across the country to those behind the scenes, working hard to keep the transportation system secure—especially as we continue to roll out new checkpoint technology that improves security effectiveness, efficiency, and the passenger experience.”

TSA is staffed to meet its wait time standards, which are 10 minutes and under in TSA PreCheck® lanes and 30 minutes and under in standard screening lanes. With this increase in travel volumes, TSA recommends airline passengers travel with ease by enrolling in the TSA PreCheck Trusted Traveler Program , where members do not need to remove shoes, belts, 3-1-1 liquids, laptops, food items, and light jackets at the checkpoint. TSA PreCheck members are reminded to make sure their Known Traveler Number (KTN) is in their airline reservation so it appears on their boarding pass.

REAL ID will go into effect in less than nine months, starting May 7, 2025. Airline passengers will soon need a REAL ID-compliant form of identification when flying. If the driver’s license is not REAL ID-compliant, they must have another form of acceptable identification, such as a U.S. passport. REAL ID driver’s licenses and identification cards have a small star in the upper right corner indicating they meet federal regulations that establish minimum security standards.

There's no 'magic answer' to Mariners' woes

LOS ANGELES -- The only positive thing the Mariners can say about their road trip is that it’s now mercifully over.

The club concluded its nightmare nine-game trip with an 8-4 loss to the Dodgers on Wednesday night at Dodger Stadium. The Mariners went 1-8 on the trip and reside five games behind the Astros for first place in the American League West, having dropped to 64-64 -- the first time they haven’t had a record above .500 since April 24.

They lost blowouts and close games , squandered both early leads and late-inning ones , set new lows for offensive futility and saw their normally dominant rotation falter. They lost in every way possible, and now return to Seattle for a six-game homestand at their lowest point.

"It's not been a good trip for us for a number of reasons,” manager Scott Servais said. “Certainly in the playoff race, you don't want to go out and basically lay an egg on a road trip. And that's what happened."

The Mariners were outscored 52-26 against the Tigers, Pirates and Dodgers. Their offense hit just .184 (the third-worst average among MLB teams in that span) and scored three runs or fewer in seven of the nine games. Their pitching staff, with struggles by starters and relievers alike, posted a 5.09 ERA (fourth worst in that span). Their 1-8 record and -26 run differential since Aug. 13 are both last in the Majors, as well.

They began their road trip tied for first place in the AL West. Now, they’re out of playoff position entirely.

"I wish I had the magic answer to what we need to do to fix it,” said outfielder Mitch Haniger, who homered in the ninth inning. “But I think it's a little more complex than that. At the end of the day, it's just each guy individually needs to continue to come in every day, stay positive, work hard and prepare to win."

Any hope the Mariners would finish their trip on a high note on Wednesday evaporated quickly in the simmering heat of Chavez Ravine.

Seattle shot out to a brief 1-0 lead on a Dominic Canzone sacrifice fly in the second, but the Dodgers quickly erased it against Mariners ace Logan Gilbert.

A two-out error by shortstop Leo Rivas in the third opened the door for the Dodgers. After Kevin Kiermaier reached on Rivas’ bobbled grounder up the middle, Shohei Ohtani walked and Mookie Betts drilled a two-run double into the left-field corner to give the Dodgers a 2-1 lead.

Will Smith's sacrifice fly in the fourth on a great catch by Luke Raley in center field extended the Dodgers' lead to 3-1, and L.A. poured it on in the fifth to chase Gilbert from the game.

Gilbert surrendered two quick runs in the frame and loaded the bases before being pulled in favor of reliever Trent Thornton. On Thornton’s first pitch of the game, Max Muncy hit a bases-clearing double down the right-field line to make it 8-1 Dodgers and turn the game into a rout.

Gilbert lasted just 4 2/3 innings, surrendered seven hits and eight runs (six earned), walked two and struck out seven. He also threw three wild pitches.

The eight runs were tied for the most allowed in a start this season by Gilbert, who entered the day with 20 quality starts -- the most in the Majors.

“Just didn't really execute the way I wanted,” Gilbert said. “Got into a lot of deep counts, stuff like that.”

The only tangible fight the Mariners showed came from Randy Arozarena.

It began in the second inning when Arozarena hit a screaming liner down the left-field line that hooked just foul of the pole at the last second. On the next pitch, Dodgers starter Jack Flaherty threw a 91 mph sinker that hit Arozarena right above his front hip.

Arozarena, who was a teammate of Flaherty's when the two were in the Cardinals' Minor League system, stood at home plate staring right-hander down for a few seconds before slowly walking to first base.

When they faced off again an inning later, Flaherty got Arozarena to fly out to right with runners on second and third. After Flaherty said something to Arozarena while the ball was in the air, Arozarena stopped running halfway down the line, put his hands up and started yelling at Flaherty, who yelled back as he walked off the mound toward the third-base dugout.

Both benches emptied, but the teams remained separated and no one was ejected.

"Randy is a very fiery competitor,” Servais said. “I love that about him, and their guy is a fiery pitcher."

In the end, not even a little spark from Arozarena could get the Mariners untracked. Now, they return home trying desperately to save their season before it’s too late.

"The talent in there is still the same talent we've had all year, and we put good stretches together,” Servais said. “So I feel very confident we will again. It's just tough to go through the road trip we just went through. We have to bounce back. That's the bottom line."
