What happens when you overstay your visa in Turkey

It is in our nature to follow rules. We are so conditioned to the idea that by breaking them, we will get punished.

Rules are made to keep people in line, to avoid chaos and to have more control. And that’s not a bad thing.

Imagine how chaotic the world would be if there wouldn’t be any laws. It would be one mad chaotic place – although, whenever we read the news, it already looks like a mad world out there…

I’m a good girl. Seriously, I am. I don’t like breaking rules and laws. Well, not the big ones and definitely not the ones with severe consequences.

I actually don’t need rules that tell me I can’t kill somebody or I can’t steal or … it’s not in my nature to do such things. But every once in awhile I do break a law.

Like when I overstayed my Turkish tourist visa by six months.

It wasn’t mine nor Niko’s intention to stay longer than the allowed period of 90 days in Turkey. We had the plan to hitchhike around the country for three months and then move on to the next destination.

But during those three months so many great and unique opportunities came on our path, like house sitting in a luxurious resort and teaching on a summer camp – just to name a few – that we couldn’t do otherwise but stay.

More than following a plan, we follow our intuition. And when our gut feeling is telling us to seize an opportunity, we will do it. Even if it means overstaying our visa. So it wasn’t really an impulsive decision but more like living in the moment.

You might judge us now and think “Hey you hippies, who do you think you are to make such a poor decision?”

We don’t see ourselves as people who are above the law and can do whatever we want to do. We see ourselves as people who follow the flow and we strongly believe that if something feels like the right thing to do, we will do it.

We’re not impulsive but we like to live in the moment. And if that moment throws us lemons, we’ll definitely make a nice lemonade! We also believe that if you do something with the right intentions, the outcome will also turn out well.

How to renew the visa for Turkey

Depending on your nationality , you can stay 30 to 90 days in Turkey. Some nationalities can visit the country visa-free (like EU citizens), others have to apply for an e-visa   (like Canadians and citizens of the USA). 

Niko and I were both allowed to stay 90 days. Before deciding to overstay our visa, we wanted to know if there wasn’t another way to stay longer in Turkey.

Extending or renewing the visa for Turkey wasn’t a possibility. Turkey has the rule that you’re only allowed to stay 90 days per 180-day period. We would have to leave the country after 90 days and could only return 3 months later.

By then that little open window to house-sit and teach would have closed and we really wanted to crawl through that window!

Another possibility was applying for a residence visa for which you need a bank statement showing a balance of at least TL 10,000 or €3000 in your account, a Turkish tax number and a place of residence certificate.

We weren’t able to provide these documents so this wasn’t an option for us either.

 Consequences of overstaying the visa for Turkey

The last option of staying longer in Turkey was overstaying our visa. Of course, we did some research about that too.

We both love new adventures and having new experiences but being locked up in prison isn’t exactly on our bucket list. Luckily this wouldn’t be one of the penalties.

We discovered that the Turkish government deals with overstays with either a fine and/or a ban from re-entering Turkey , depending on the length of the overstay.

Determining how much we would have to pay or how long we would get banned for , was harder to figure out.

In practice, these guidelines vary wildly and depend on your nationality. Various websites showed us various prices but in general, the fine would be a minimum of $50 plus $0.40 (for European citizens) and $1 (for Canadian citizens) per day of overstay.

If you overstay more than 15 days, a ban to re-enter the country could be carried out and varies from 90 days up until 5 years.

We also read that we could refuse to pay the fine , which would automatically result in a ban from re-entering Turkey. But mostly the consequences would depend on the mood of the immigration officials on our day of exit.

What happened when we overstayed our visa for Turkey

We had such a wonderful time in Turkey (watch our videos here to see all the good things that happened to us) that we eventually overstayed by nearly six months . During that time we didn’t worry about it too much.

But on the day we left the country I was very nervous.

I felt butterflies in my stomach when we reached Sarpi, the border village between Turkey and Georgia. My heart was pounding in my chest when the Turkish migration officials examined our passports at the border control.

I wasn’t surprised that we were ordered to step aside and follow one of the officials to a small office. What did surprise us was that we weren’t alone there.

There had been a coup in Turkey and since then many Turkish citizens who work for the government (teachers, bank employees,…) were being restricted. If they wanted to leave Turkey, they have to go through certain procedures.

There were many people that day at the border and everybody was very occupied with the paperwork. This was to our advantage as nobody wanted to spend a lot of time on our case.

After a few minutes of waiting outside the office, I was called in first. When I entered the room, the woman behind the desk asked me if I had already paid my fine.

When I told her I hadn’t, she showed me a little note on which the amount of the fine was written. It was 170 Turkish Lira, the equivalent of €55. I couldn’t believe that the fine turned out to be so cheap! I expected I’d have to pay more than €200.

The only problem was that I only had TL50 cash on me so I asked if there was an ATM around where I could take money out or pay with my bank card. She shook her head, which I took as a no to both questions.

She stamped my passport and just let me go without saying another word. I think she just wanted to get on with the rest of her work.

When Niko entered the office, the official didn’t even tell him how much he had to pay. She asked him if he had cash and when Niko showed her the bank card instead, she also just stamped his passport. He was also free to go.

We couldn’t believe that was it. Nobody even told us if we were banned from the country. We double-checked the stamp on our passport but it looked like a normal one.

I think we will only find out the day we want to apply for a new tourist visa for Turkey. 

So we got very lucky! This doesn’t mean that everybody will be that lucky . Please don’t overstay your Turkish visa now. Recently a friend told us that she was charged $200 at the airport in Istanbul for overstaying just one day. A lot depends on where you cross the border, who you are dealing with and how busy they are!

So if you ever (un)intentionally overstay your visa, always double-check the regulations and hope for the best. We are now moving towards countries that wouldn’t be so relaxed about it so we’ll do our best to follow the rules again!

Update 2020: We tried to re-enter Turkey after 4 years, it didn’t work. We got deported. We now know that we’re banned from Turkey for 5 years.

Hello, I am US Citizen, we have a 90 day visa. So I booked my plane ticket from May 3-August 3. Which I thought was 90 days, when I went to fly out of Istanbul. I was informed I overstayed my Visa. To go to Visa office and then return, I explained to him, he said I overstated by 2 days. They don’t count months, but days. I told him I was unaware and thought it was 90 days.

He told me I could go, he didn’t give me anything to pay a fine. I seen people leaving with a white sheet of paper. I wasn’t given a thing.

Same happened to me and turned out I was banned from the country for 5 years. Best is to check with the Turkish embassy in the US for more information about your consequences (if you have any).

Hi Lawrence, you should apply for a new visa at the Turkish Embassy. I don’t know if they will give one. I was banned for 5 years before I could apply for a new visa. Good luck!

I had to overstay my visa back in 2014 as I was a refugee so I overstayed my visa more than two years because it was special circumstances with the agreement of local police anyway we left the country in 2014 with the expectation of getting band for 5 years anyway I went back in 2021 with different passport from a different country with my visa and I was refused entry and they deported me back without any information about a fine even though it was over 5 years I tried to explain no one listened. Now I’m trying to go back I got a visa from the embassy and I explained to them what happened they issued me a visa but they said it’s not %100 guaranteed and u need to pay a fine when u go. I’m happy to pay the fine as long as I get an entry without getting treated like a criminal what’s your thoughts and advice regarding this issue and how much should I expect the fine would be ? TIA

Hi there, I overstayed my tourist visa for about 3 months in Turkey because the university I was having an exchange with waited months to submit my residence permit. I paid the fine and the officer did not tell me anything about being banned. This all happened about 3 years ago. Now I will have to travel to Dubai and have a short stopover in Istanbul for 2 hours. You don’t have to worry about transiting in Istanbul. I did that during the time I was banned from Turkey and as long as you don’t enter the country, you’ll be fine 🙂

Hello. I was told to contact Voya visa in London or Edinburgh. You have to pay £216 and they apply to get the ban anointed. I tried ringing the Turkish Embassy as soon as I returned to pay the fine but they wouldn’t let me. I hope this helps

Hey guys! Thanks for the info. We’re currently overstaying our visa in turkey, apparently we can overstay by up to 90 days, and then fine is quiet small apparently the full 90 days will be 70USD + 160tl.

My question is we’re hoping to catch a domestic flight to Istanbul from fethiye or somewhere around there, did you have any troubles flying between places at the airport? As I know they like to check your passport at check in, I just can’t remember if they check your entry stamp or just ID

While we were overstaying, we were traveling overland so we didn’t take any domestic flights. I don’t think it will be a problem. However, know that even if you pay the fine, it might happen that you’ll be banned for a while from Turkey. You should check with your embassy in case you like to return within 5 years so you don’t get the surprise we got 😉 All the best!!

What happens when you overstay the Turkish visa –

This is the perfect blog for anyone who really wants to understand this topic. You realize a whole lot its almost hard to argue with you (not that I really would want to…HaHa). You certainly put a fresh spin on a subject which has been discussed for a long time. Wonderful stuff, just wonderful!

Hi there, First of all, there are such people who might talk a lot with nonsense approaches with a diplomatic mouth but they are actually not related to anything belongs to the Turkish authorities. So, first, ignore them. I am the Turkish, and I know a lot of Turkish people can talk in this manner. But same as everywhere in the world, I see worst people in other countries more than Turkey, but let’s not compare.

If you overstay and leave the country without the payment, you have 10 days to fly back to Turkey to pay the fee. If you don’t do it, you will get banned. This is the current rule. I don’t know what was your situation and when was it exactly, because you might miss some part of it, but it’s fine.

Turkey is a good country where people doesn’t want to ban you, but they have principal approaches which must be applied in a professional manner, that means, if you need to pay your overstay, you have to do that, same as everywhere in the world. What if you don’t;

1- You can appeal to the court to find another result, and wait for hopes, and you have to accept the result if they force you to pay after the fee. 2- You can reject everything without appeal or after appeal forces you to pay, which will have a result of 5 years or maybe even permanent ban depends on the situation. 3- You might just pay it which is also what it should be.

I have traveled over 100 countries without breaking any rules, I know you are also sensitive, just if you break the rules, try to respect the country which will bring better results for a better revisits.

In some countries, overstay costs you lifetime permanent ban and there are no exceptions even the fee. One of them was Singapore as I remember. It was also the modern country which they give a white/red paper that contains information which declares “we might be executed if they find drug on us”, if they consider most likely drug trafficking, same as the Malaysia.

Hi Yusuf, we understand your concern and also want to clarify something here: we did expect that we had to pay a fine. The official at the border did charge us a fine. We also were ready to take the consequences of our actions and wanted to pay but we didn’t have any cash money on us left. So when I showed to official my bank card, she told me I couldn’t pay with it. When I asked if there was an ATM around so I could take the money out, she looked really annoyed like she couldn’t be bothered and stamped my passport with an exit stamp.

Until today I have no idea why I wasn’t able to pay with my card. I should be as everything went through an official entity. Anyways, it’s a one-time thing and we’d never overstay our visas again as we just don’t want any trouble with the authorities and do respect the countries we visit. In case we’d be banned, we have one year left and will be able to visit Turkey again in 2021. We’d love to return there!

Hi! My name is Ana, I am Portuguese and I am doing an internship in Istanbul for 4 months! I have a tourist visa that only covers 3 months, and I decided not to get the resident permit because it would be too expensive considering I am only staying for one extra month! My question to you is, how did you manage to travel throughout Turkey without the visa? Because I still have a valid visa (it only expires in April) and I just went to Cappadocia, and in the bus trip we were stopped 2 times for passport control!!!

Hi Ana, after reading your situation, I wouldn’t recommend overstaying your Turkish visa. You have to know that when we overstayed, the situation was quite different (it was shortly after the coup) and we got very lucky. We always traveled overland, never took a domestic flight and never got a passport check during our travels. You could overstay by an extra month but know that you’ll have to pay a fee and/or get banned from the country for a certain time. When we crossed the border into Georgia, it was very chaotic at the border control and we suspect that they let us go without paying a fee because they couldn’t be bothered. We think (but we’re not sure) we’re banned from the country for 5 years or so (2 more to go 😀 ). So if you choose to overstay, know that there will be consequences. It’s also very likely that they will notice it at the airport whenever you take a domestic flight. You’re better off traveling overland if your visa is expired. You might also look into the possibility to renew your visa by leaving the country for a day or 2 (maybe go for a short holiday to Greece) and return. I am actually having the same problem now..I applied to extend my residence permit from internet and they gave me an appointment in september, but my ticket to go back to morocco is 27 of august..so i went to the police office and I asked them if ot is possible to make my residance before leaving, but he refused and told me either i wait the date that they give me or i will yave to pay the penality in the airport…I dont want to pay the penality because it is kind of unfair for me to apply since july and wait until september, I don’t know..I was student here but now I graduated and I had to wait for more than two months just to apply in the police office..I am just scared that they will put me in jail when I will be in the airport..i know this will be the worst case, but I am very nervous person that’s why…I hope everything will be fine..thank you for the informations

Hi Hasna, don’t worry, they won’t put you in jail for overstaying your visa by a few months. However, they will give you a fine and if you don’t pay it, you might get banned from the country which – as I can read – you don’t want if you want to stay for a longer time in Turkey. Hello, I have the same problem as you guys, I am living in Istanbul since 5 the ago. Hi Maria, sorry to hear that your residence permit got rejected. How long have you been in Turkey already? And what’s your nationality? We wouldn’t advise overstaying your tourist visa, especially not if you have long-term plans of staying there in the future. I just experienced it 2 days ago and now i realized that the linger you overstay the less money you will be asked to pay. I was 10 mins overstay and they asked me to pay 140 usd at sarpi border which in the past i passed with no problem for 15 hrs overstay as it was a very crowded day and i was flown with the people current, and they just stamp without noticing anything else, so its actually depedlnded on the circumstance but i agreed as never overstay or make it worthwhile like if you would never ever had a chance to come back ever again 🙂 By the way, i ended up not paying anything and got stamp on my passport and they didnt say anything about deported or ban, so im still gonna findout if they could fine me when i returned to the country or not. Anyway, im now safe in Georgia and pretty enjoy it here.

My tourist visa ended on April 11th, 2017. Now i am taking care my resident permit and just got a randevu on May 9th and now i am on process to finish all for the resident permit because the officer give me time 1 month after the randevu date. My question is on June 22nd i got to go back to my country (i need to join the graduation ceremony in my university), but i wonder when i pass the passport control gate will i pay for the overstay penalty or i just show to the officer that i already take care my resident permit (even it might be not yet done and still randevu)? And also if i already pay for the resident permit before i fly back to my country, when i come back again to turkey should i apply again a resident permit? What kind of visa i made for me to come back again to turkey? Will i get banned to re-entering turkey?

I’m not sure if I’m the right person to answer these questions for you. I think that once you have your residence permit , there shouldn’t be any problem at customs and you should also be allowed to travel in and out of Turkey with this permit. If you don’t have it by the time you’re leaving Turkey, maybe ask for documents as proof that you’re applying for it. In case you don’t have your residence permit yet and you have to pay a fine, pay it and you should be allowed back in the country on another tourist visa. There is a policy though that you can only stay 90 days in a period of 180 days on a tourist visa. I’ll just keep my fingers crossed that you have your residence permit on time and then you shouldn’t have to worry about all of this 🙂 Good luck!

I understand, so now i just need to try as soon as possible to get my residence permit before i leave turkey for a while. Anyway, about my visa, actually my visa only allows me 30 days to stay and valid for 180 days since it was issued. But i don’t understand about this. Can you explain me about how my visa works? I have no idea because i got it by e-visa not from consulate office. since i was arrive in turkey on March 11st so i already stay more than 30 days until my flight on June. So my total days for overstay i guess since April 10th until my leaving day later which is mean 73 days, just in case my residence permit not yet finish, i got to pay the fine in the airport on my leaving day, can you guess how many TL i got to pay? I am from List A countries.

Oh, so this is what you did! I was wondering how come you stayed for so long. We actually did get the residence permit for six additional months – it wasn´t as hard as it seemed and they didn´t care about us having enough money. We got a paper from the notary where our friend stated we are living in his house (which we obviously don´t)(and long live Turkish couchsurfers), paid the fees, insurance (which is useless, just saying) and all that. The tax number is easy to get and you do it within ten minutes right in the office where you pay. It was rather complicated to figure out what exactly to do, but the immigration officers were very helpful, spoke English and with a bit of back and forth we were able to obtain it.

I am an American currently living on the south coast of Turkey near Dalyan. I returned here after living in France for almost 5 years. When I left for France when I moved there I went to the Jandarme in Mugla because i had overstayed my visa by 3 1/2 years. My fine at that time (2009) was 3900 Turkish Lira and according to the female Jendarme officer I would have no ban – as I intended to return for a visit 6 months later. Six months later I flew from Brussels to Dalaman and at the airport was detained and informed that I was under a 3 1/2 year ban. I told them that the Jandarme officer assured me that there would be no ban, but to no avail. I was placed back on the same plane and returned to Brussels. So, I would highly suggest before ever returning to Turkey that you apply for an entry visa at a Turkish embassy in the country you depart from. If they issue the visa it’ll over-ride the airport customs peoples opinion about any ban. If the embassy tells you that you are banned, then at least you won’t find yourself being immediately deported upon arrival. And should decide to return (which I know you will after having been here before) drop me a line and come by and visit my wife and myself.

Well, it only took 5 1/2 months to respond to your question, but in answer I really do not know exactly how long the ban was for but returned in 2014 without obtaining a visa first. I was a little nervouse at the airport when entering and held my breath until I saw his hand with the visa stamp descend onto my passport with a resounding “thump”. But I would say the visa situation everywhere is getting more and more restrictive and obtaining a visa prior to arrival is the best way to go.

I think that you were better leaving by land than trying to fly out. If your friend paid $200 for a day, what would six months work out as?

What we found very strange was that she had to pay that much for just one day! Maybe it was of her nationality (Russian) but it shouldn’t even have been that much! Again more proof that there is not one strict guideline that tells you what will happen. So a lot depends indeed on which border you cross.

Please re-read the part where we CLEARLY STATE that we do not know if we are banned. If the Turkish border workers didn’t accept our payment by credit card, that is not our responsibility. It is the responsibility of the Turkish authorities to insure that people overstaying their visa can pay the fine by card.

Bulgaria – Valid ordinary passport c) Holders of diplomatic, special and official passports GENERAL INFORMATION - Visitors who are not exempt from entry visa must obtain their visas or schedule an appointment with the Turkish Consular offices via Pre-Application System for Turkish Sticker Visa ( www.visa.gov.tr ). The applicants who meet the requirements will be directed by the Pre-Application System for Turkish Sticker Visa to the e-Visa system ( www.evisa.gov.tr ) In those countries where Türkiye does not have a consular representation can also use online scheduling for appointments with the nearest accredited consular office of Türkiye. - In order to avoid inconveniences that may be caused by delays in processing, it is recommended to apply for visas at least one month in advance before the planned travel. - The visas submitted to foreigners do not guarantee absolute rights of entry to Türkiye. - Visa fees are not refundable in cases where applications are rejected - All applicants are required to have a medical insurance that will be valid during their stay in Türkiye. - The length of stay provided by visa or visa exemption cannot exceed 90 days within each 180 days. The regulation of 90 days of stay within the last 180 days is binding for all foreigners that will travel to Türkiye. - It is not possible for foreigners holding two passports to stay in Türkiye for 90 days each with their two different passports within the last 180 days. - In all types of visa applications, Turkish consular offices may issue visas with a maximum duration of stay of 90 days. The foreigners who wish to stay longer than 90 days in Türkiye, should apply for “Short Term Residence Permit” at the Provincial Directorate of Migration Administration in order to extend their residence. - The residence permit of the foreigners will be cancelled if they stay outside Türkiye for longer than 120 days in total during the last year. - For United Nations (UN) Travel Document (Laissez-Passer) holders who have blue UN travel documents, visa exemption with 90 days length of stay within the preceding 180 days may apply during their official visit to Türkiye if they can certify their official assignment. Red UN Travel Document holders, shall be exempt from entry visa and may stay in Türkiye 90 days within the preceding 180 days regardless of their purpose of visit. General visa provisions shall apply for Blue UN travel document holders subject to regulations specified according to their country of origin. - Visa applications for travels except for touristic or trade purposes (work or study etc.) will need to obtain visa through Turkish Representations in the abroad. - Regardless of the visa regime applied towards the citizens of a country, the travel document holders of that country need to obtain visa from Turkish missions beforehand. - Any applicant under the age of 18 must submit official written approvals from both parents. For those applicants who certify that their parents are officially divorced and prove the parent holding their custody as well as for those with one parent deceased, visas may be issued in accordance with their purpose of visit. - The authorization of processing the residence permit applications submitted by the following persons who enter Türkiye availing visa-free regime and without requirement of obtainment of Student Visas lays with Local Immigration Offices (Provincial Directorates of Migration): Foreigners who arrive in Türkiye upon invitations by universities under Turkish Higher Education Board to study at the associate, undergraduate, graduate, post-graduate, Ph. D levels pursuant to international student exchange programs, cultural programs as well as under EU Education and Youth Programs. - For foreigners wishing to enter Türkiye via naval ports with touristic purposes, visa-free entry permits may be issued by the local governorates. These permits shall have a maximum 72 hours duration of stay and will be only valid for sightseeing purposes in the vicinity of naval ports where they entered the country. This practice, as it intends to facilitate entry for those visitors subject to visa, does not entitle visitors to visa. Passports of these visitors are not retained by the border authorities; however, visitors are given "Harbor City Entry Permit" which is required to be returned to the authorities upon their exits. - Any piece of data submitted here may be processed and stored in database accessible to the relevant Turkish authorities in accordance with their respective mandates. Tourist Visa - If an invitation letter is submitted for a Touristic Visa application, it must include the inviting person's TR Identity Number, clear identity, the list of invitees, permanent address, contact number, length and purpose of stay and the affinity with the applicant must be stated in the letter. If the inviting side is an organization or a company, tax registration certificate of the organization will be required. In the invitation letter it is also required for the inviting person/authority to pledge for covering victuals and accommodation expenses and for taking their own responsibility. The applicant is required to have sufficient and/or regular remunerations. Working Visa: - Foreigners lay their applications for work permit through our consular offices in the country of their residence or nationality. - To work in Türkiye, you must apply to the nearest Turkish mission to obtain work permit and visa. Your passport, visa application form and a letter from your employer are the necessary documents for your application. Other documents should be submitted to the Turkish Ministry of Labor and Social Security (MLSS) by your employer within ten working days after your application. - Work Permit Applications are concluded positively or negatively by the Ministry of Labor and Social Security. Work Permits have equivalence to residence permits. Thus, should a working permit is approved by the Ministry, the foreigner is charged an Entry Visa Fee, Work Permit Certificate Fee and Residence Fee by the Turkish consular offices. Since Work Permit Card substitute residence permit in Türkiye, "Work Annotated Visa" issued by these offices can only be used for entrance and for 90 days at maximum. - You may find the list of those documents in the MLSS’s website ( http://www.csgb.gov.tr ). Applications are finalized by the MLSS within thirty days at the latest. Right after your arrival in Türkiye (before starting to work), you should be registered at the local police department within one month to obtain the necessary residence permit. - Work permit is granted to foreigners who will work in Free Zones in our country by the Ministry of Economy, to those to work in units under Ministry of Culture and Tourism by the mentioned Ministry and to foreign national personnel to work in universities by the Higher Education Board. Internship Visa / Work Permit Exemption: - Applicants need to obtain a work permit from the Ministry of Labor and Social Security pursuant to the Law numbered 4817 for private internship applications outside the provisions set forth in the Article 55 "Work Permit Exemption" title of Law Enforcement Regulation about Working Permits of Foreigners. - Article 55 of the Law Enforcement Regulation on Working Permits of Foreigners no. 4817 regulating working permit exemptions, the extent and the lengths of time the foreigners are exempt from working permit are stated. Those who meet the requirements below do not need to obtain a work permit. (1) Without prejudice to the provisions set out in specific laws and on condition that the foreigner and the employer fulfill their obligations resulting from other laws; a) The persons exempted from work visa under the bilateral or multilateral agreements to which Türkiye is a signatory party, b) the foreigners holding permanent residences abroad and wishing to visit Türkiye temporarily with purposes of scientific studies, cultural and artistic activities for a period shorter than a month and with the aim of sporting activities for a period less than four months, c) For the purpose of installation, maintenance and repair of machinery and equipment imported to Türkiye, providing training for their utilization or transporting of defective equipment from Türkiye and provided that they do not exceed the total stay of three months within a year as of the date of entry into Türkiye and verify this condition with the documents that they will submit, the ones coming to Türkiye, ç) For the purpose of training in the use of goods and services exported from or imported to Türkiye and provided that they do not exceed three months totally within a year as of the date of entry into Türkiye and verify this condition thanks to the documents that they will submit, the ones in Türkiye d) Being an entertainer, performer and etc. in charge at fair and circuses which are going to carry out activities outside the borders of certificated tourism establishments and provided that they do not exceed six months as of the date of entry into Türkiye and verify this condition with the documents that they will submit, the ones in Türkiye e) On condition that it does not exceed two years and it will be limited to the period of study, the foreigners coming to state institutions and organizations together with the universities so as to enhance their information and good manners by verifying their state via the documents that they will submit, f) Persons who notified the Turkish authorities on the fact that they will provide important services and contributions socio-cultural and technological fields and educational fields within a period not exceeding six months. g) Persons visiting Türkiye under the programs of the Center for European Union Education and Youth Programs (National Agency), ğ) The foreigners to go on a training under the framework of international trainee programs sanctioned by the Higher Education Board, the Ministry of Interior and the Ministry of Foreign Affairs. h) The foreigners who are the representatives of tour operators coming to Türkiye on condition that the term of contract does not exceed eight months, ı) During the contracts of other athletes, trainers, football players whose requests are approved by Turkish Football Federation or General Directorate of Youth and Sports i) By the bilateral protocols signed under the Rule no. I/10 of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, the foreign seafarers serving on vessels which have received " Conformity Approval Certificate" from the related administration and is registered in Turkish International Ship Registry Law and operate outside the cabotage line, j) Foreign experts employed in the projects that are conducted within the scope of Türkiye-European Union Financial Cooperation Programs are not in need of obtaining a work visa during their term of office. - Within the scope of article 55, residence permits of the foreigners coming to Türkiye are given as “Short Term" residence permits by Provincial Directorate of Migration Administration. Exemption periods cannot be extended, the foreigners under this provision can make use of exemption rules only once within one calendar year. However, it is required that it must have been three months as of the expiry date of the residence permit granted to the foreigner with the same purpose in order to exercise this right. In case of the need of working longer than the exemption period allows, the foreigner has to obtain a work visa through the Ministry of Labor and Social Security. Tour Operator Representative Visa - The foreign representatives of tour operators, are exempted from obtaining a work visa for their duties for up to eight months. The applications of the foreigners asking for a residence permit from Provincial Directorate of Migration as the representatives of tour operators are processed under rules regulating touristic visits. Transportation Visa - The foreigners applying for visa for transportation may be given a multiple entry visa valid for one year in case they submit the required documents. - Visa regime for truck drivers of a country may differ from the overall visa regime effective for citizens of that particular country. For further information, please contact the nearest Turkish mission. The Personnel Assigned for Foreign Religious Foundations - The personnel employed officially in foreign religious foundations in Türkiye - Work permits of the foreigners employed in religious foundations are under the framework of exceptional condition. Applications of permission are made via our Ministry and residence permits are issued by the Ministry of Internal Affairs so that they can work in our country. Archaeological Excavation, Exploration, Documentary Purpose Visas - Foreigners who will shoot a documentary film conduct a research or an archeological excavation should get a special permission from the Turkish authorities in advance. - It is necessary that the one should enter Türkiye by obtaining a relevant visa via our foreign representatives for excavation and research. - The foreigners to come to our country for the purpose of movie and documentary shooting should obtain a permit document from the Ministry of Culture and Tourism, Directorate General of Cinema and the provincial Governorate. - One can directly apply to the related institutions for scientific researches, sound track recording, filming documentaries and movies, photo shooting to be carried out on archeological, historical, geological, sociological and natural issues in Türkiye, on land, in the air, at sea, at river and at lake. My fiancée has been in Turkey since January 21, 2023 on a work Visa with 30 of his staff. Due to the earthquakes and having to rebuild part of a building they have overstayed their work Visa. On July 31, 2023 he and his manager were robbed and both shot, one seriously. The stolen money was for paying fines and he has no way to get such a large sum now. Leave Permit means the document which is not subject to any fees, and which is issued to persons for whom a period to leave Turkey is granted pursuant to Article 56 of the Law on Foreigners and International Protection. . Removal Center means a center in which the foreigner subject to administrative detention is held. . Summons to Leave Turkey means that where a removal decision has been issued, foreigners shall be granted a period no less than fifteen days and up to thirty days to leave Turkey, provided that this period is stated in the removal decision. . . . WHICH PERSONS ARE SUBJECT TO REMOVAL DECISION IN TURKEY? . In case one or some of the situation stated in Article 54 of the Law occurred, the governorate must issue removal decision without prejudice to the provisions of Article 55 of the Law. . A removal decision shall be issued in respect of those foreigners who are listed below and who are within the scope of paragraph one of Article 54 of the Law on Foreigners and International Protection. .

  • Foreigners who are deemed to be removed pursuant to Article 59 of the Turkish Penal Code № 5237 (a. 54/1-a) .
  • Foreigners who are leaders, members or supporters of a terrorist organization or a benefit oriented criminal organization (a. 54/1-b) .
  • Foreigners who submit untrue information and false documents during the entry, visa and residence permit actions (a.54/1-c) .
  • Foreigners who made their living from illegitimate means during their stay in Turkey (a.54/1-ç) .
  • Foreigners who pose a public order or public security or public health threat (a.54/1-d) .

  • Foreigners whose international protection claim has been refused; are excluded from international protection; application is considered inadmissible; has withdrawn the application or the application is considered withdrawn; international protection status has ended or has been canceled, provided that pursuant to the other provisions set out in this Law they no longer have the right of stay in Turkey after the final decision (a.54/1-i) .
  • Foreigners who fail to leave Turkey within ten days in cases where their residence permit renewal application has been refused (a.54/1-j) .
  • Foreigners who are applicants or international protection beneficiaries solely when there are serious reasons to believe that they pose a threat to national security of the Turkey (a. 54/2) .
  • Foreigners who are applicants or international protection beneficiaries solely if they have been convicted upon a final decision for an offense constituting a public order threat. (a. 54/2)

. . WHO ARE EXEMPTION FROM THE REMOVAL DECISION IN TURKEY? . Removal decision shall not be issued in respect of those foreigners listed below regardless of whether they are within the scope of Article 54: .

  • When there are serious indications to believe that they shall be subjected to the death penalty, torture, inhuman or degrading treatment or punishment in the country to which they shall be returned to (a.55/1-a) .
  • who would face risk due to serious health condition, age or, pregnancy in case of travel (a.55/1-b) .
  • who would not be able to receive treatment in the country to which they shall be returned while undergoing treatment for a life threatening health condition (a.55/1-c) .
  • victims of human trafficking, supported by the victim’s assistance programme (a.55/1-ç) .
  • victims of serious psychological, physical or sexual violence, until their treatment is completed (a.55/1-d) .

The assessment regarding whether the foreigners are within the scope of Article 55 or not shall be carried out for each foreigner. In order to stay in Turkey, those foreigners may be granted humanitarian residence permit pursuant to Article 46 of the Law on Foreigners and International Protection and those foreigners may be asked to reside at a given address and report to authorities in form and periods as requested. . In cases where they lose their status, removal decision shall be issued in respect of the foreigner. . . WHAT IS APPEAL AGAINST REMOVAL DECISION IN TURKEY? . Removal decision together with its reasons shall be notified to the foreigner for whom a removal decision has been issued or, to his/her legal representative or lawyer. If the foreigner for whom the removal decision has been issued, is not represented by a lawyer, the foreigner or his/her legal representative shall be informed about the consequence of the decision, procedures and time limits for appeal. . . HOW TO APPEAL TO TURKISH ADMINISTRATIVE COURT AND ITS FEATURES? . Foreigner, legal representative or lawyer may appeal against the removal decision to the administrative court within fifteen days as of the date of notification. . The person who has appealed against the decision to the court shall also inform the authority that has ordered the removal regarding the appeal. . Such appeals shall be decided upon within fifteen days. . The decision of the court on the appeal shall be final. . Without prejudice to the foreigner’s consent, the foreigner shall not be removed during the judicial appeal period or until after the finalization of the appeal proceedings. In other words, in cases where the removal decision shall be subject to judicial appeal, the request for the suspension of execution shall not be also required. Because, the application shall suspend the procedure ex officio. . As the right to  individual application is granted to everyone pursuant to the Constitution, the foreigners for whom a removal decision has been issued shall appeal against the decision to the Constitutional Court pursuant to the decision of administrative court. . . W HAT IS THE ADMINISTRATIVE   DETENTION DECISION BY TURKEY MEAN? . Those for whom a removal decision have been issued, the governorate shall issue an administrative detention decision for those who;

  • Bear the risk of absconding or disappearing;
  • Breached the rules of entry into and exit from to Turkey;
  • Have used false or fabricated documents;
  • Have not left Turkey after the expiry of the period granted to them to leave, without an acceptable excuse;
  • Pose a threat to public order, public security or public health.

Foreigners subject to administrative decision shall be held in removal centers. . The duration of administrative detention in removal centers shall not exceed six months. However, in cases where the removal cannot be completed due to the foreigner’s failure of cooperation or providing correct information or documents about their country [of origin], this period may be extended for a maximum of six additional months. . The need to continue the administrative detention shall be regularly reviewed monthly by the governorates. When consider it necessary, thirty-day waiting period shall not be applied. . Those foreigners where administrative detention is no longer considered necessary shall immediately be reported to the Ministry. Administrative detention decision for the foreigner shall be revoked provided that the Ministry considers it appropriate and the foreigner shall be issued a Leave Permit. These persons may be asked to reside at a given address and report to authorities in form and periods as requested. . . HOW TO APPEAL AGAINST THE DETENTION DECISION MADE BY TURKEY? . The administrative detention decision, the extension of the administrative detention period and the results of the monthly regular reviews together with its reasons shall be notified to the foreigner or, to his/her legal representative or lawyer. If the person subject to administrative detention is not represented by a lawyer, the person or his/her legal representative shall be informed about the consequence of the decision, procedure and time limits for appeal. . . HOW IS APPEAL MADE TO THE TURKISH JUDGE OF THE CRIMINAL COURT OF PEACE? . The person placed under administrative detention or his/her legal representative or lawyer may appeal against the detention decision to the Judge of the Criminal Court of Peace. . Such an appeal shall not suspend the administrative detention. . In cases where the petition is handed to the administration, it shall immediately be conveyed to the competent Judge of the Criminal Court of Peace. . The Judge of the Criminal Court of Peace shall finalize the assessment within five days. . The decision of the Judge of the Criminal Court of Peace shall be final. . The person placed under administrative detention or his/her legal representative or lawyer may further appeal to the Judge of the Criminal Court of Peace for a review should that the administrative detention conditions no longer apply or have changed. . Those who appeal against an administrative detention action but do not have the means to pay the attorney’s fee shall be provided legal counsel upon demand, pursuant to the Legal Practitioner’s Law № 1136 of 19/03/1969. . . WHAT IS SUMMONS TO LEAVE TURKEY MEAN? . Where a removal decision has been issued, foreigners shall be granted a period no less than fifteen days and up to thirty days to leave Turkey, provided that this period is stated in the removal decision. . A Leave Permit shall be issued to persons for whom a period to leave Turkey is granted. This document shall not be subject to any fees. . Among those who have been invited to leave Turkey, an entry ban might not be imposed for those who leave the country within the specified period of time. . Foreigners who do not leave the country within the specified period of time shall be placed under administrative detention. . The following foreigners shall not be invited to leave Turkey and the period mentioned above shall not be applied to those who: .

  • Bear the risk of absconding or disappearing .
  • Have breached the terms and conditions of legal entry and exit .
  • Use false documents .
  • Attempt to obtain or are determined to have obtained a residence permit with false documents .
  • Pose a public order, public security, public health threat .

. WHAT IS THE IMPLEMENTATION OF THE REMOVAL DECISION? . The foreigners at removal centers shall be taken to border gates by law enforcement unit. . Foreigners to be removed without being required to transfer to removal centers shall be taken to the border gates by law enforcement units through coordination of the provincial units of Directorate General. . The Directorate General may cooperate with international organizations, the authorities in the relevant country, and non – governmental organizations to carry out the removal. . . TRAVEL COSTS FOR THE FOREIGNERS TO BE REMOVED FROM TURKEY . Passports or other documents belonging to foreigners may be retained until the foreigners are removed and their tickets may be cashed for use in the removal. Foreigners to be removed shall cover their own travel costs. In cases where foreigners are unable to cover such costs, the full or remaining cost of travel shall be met from the budget of the Directorate General. A ban on entering Turkey may be imposed for such foreigners as long as the costs are not reimbursed. . The limitation to be imposed for the situation in which the foreigner cannot cover the costs shall be considered as the reason of limitation by its nature. In case another ban has not issued to the foreigner, the restriction shall be removed provided that s/he covers the costs and the foreigner shall be allowed to enter into the country. . Costs related to the removal of the foreigner are public receivables pursuant to the Article 1 of the Law No 6183 and they shall be collected by financial cashier office. Pursuant to the Article 104 of the Law No 6183, as the debtor is in the foreign country, the receivable shall not be subject to the lapse of time. For this reason, there is no obstacle to impose indefinite limitation on the foreigner. . Natural or legal persons are responsible for covering the costs related to the removal of foreigners whose stay and return they have guaranteed. . The paragraph 3 of the Article 21 of the Law No 4817 on the liabilities of the employers or employer representatives who employ the foreigner without work permit regarding the removal process of the foreigner shall stipulate that “An administrative penalty of five thousand Turkish liras shall be given to the employer or employer representatives for each foreigners that does not have working permission. In this case, the employer or representative of employer is obliged to cover the accommodation expenses of the foreigner and his/her spouses and children, if any, the expenditures required for them to return to their countries and health expenses when required.” The process shall be established within the framework of this regulation. . .
