(!)Turistas įsipareigoja, kad pasas galiotų ne trumpiau kaip 6 mėnesius skaičiuojant nuo kelionės pabaigos dienos (Turkija, Egiptas ir kt. ne ES valstybės) (vykstant į kai kurias valstybes, gali būti reikalaujama ir 12 mėnesių galiojančio paso). Tikslios informacijos teiraukitės mūsų konsultantų. Kelionių organizatorius neatsako už pasienio ir migracijos tarnybų priimtus sprendimus turisto atžvilgiu. 1. SUTARTIES ŠALIŲ ĮSIPAREIGOJIMAI 1.1 Kelionių organizatorius įsipareigoja: 1.1.1.Organizuoti turistui(-ams) turistinę kelionę pagal programą, nurodytą kataloge ar kitoje kelionę aprašančioje medžiagoje, arba, jeigu kataloge ar kitoje kelionę aprašančioje medžiagoje nurodytos kelionės programoje buvo padaryti pakeitimai iki šios sutarties pasirašymo, pagal pakeistą programą. Naujausia ir aktualiausia informacija yra skelbiama kelionių organizatoriaus internetiniame puslapyje www.novaturas.lt . Organizuota turistinė kelionė lėktuvu gali būti vykdoma užsakomuoju arba reguliariuoju skrydžio reisu. Užsakomąjį skrydžio reisą gali vykdyti oro vežėjai Avion Express, Getjet Airlines, Freebird Airlines. Reguliarųjį skrydžio reisą gali vykdyti oro vežėjai: Ryanair, Wizz Air, Turkish Airlines, Lufthanza, Air Baltic, Ukraine International Airlines, Finnair, Condor ir kt. 1.1.2.Nesurinkus minimalaus turistų skaičiaus, pranešti turistui apie sutarties nutraukimą patvarioje laikmenoje ne vėliau kaip iki kelionės pradžios likus: 1.1.2.1. 20 dienų, jeigu kelionės trukmė yra ilgesnė negu 6 dienos; 1.1.2.2. 7 dienoms, jeigu kelionės trukmė yra ne trumpesnė negu 2 dienos ir ne ilgesnė negu 6 dienos; 1.1.2.3. likus 48 valandoms, jeigu kelionės trukmė yra trumpesnė negu 2 dienos. Minimalus turistų skaičius kelionėje užsakomuoju lėktuvo reisu yra 180 keleivių lėktuve, o kelionėje autobusu – 25 turistai. Minimalus pažintinę kelionę lėktuvu įsigijusių turistų skaičius – 15 turistų. Turistams laiku ir tinkamai pranešis apie sutarties nutraukimą ir grąžinus už kelionę sumokėtus pinigus, kelionių organizatorus neatsako už turistų patirtą žalą. 1.1.3.Prieš kelionę turistui tokia forma, kaip buvo sudaryta sutartis arba kita turisto pasirinkta forma, pateikti būtinus kvitus, kuponus, bilietus, informaciją apie numatytą išvykimo laiką ir, kai taikytina, registracijos terminą ir numatytą laukimo tarpinėse stotelėse, transporto jungčių ir atvykimo laiką; 1.1.4. Suteikti bendro pobūdžio informaciją apie kelionės šalies paso ir vizos reikalavimus, įskaitant apytikslę vizos išdavimo proceso trukmę, ir informaciją apie su sveikata susijusius formalumus (informaciją apie valstybių, į kurias vykstama, užkrečiamųjų ligų epidemiologinę būklę, privalomas ir rekomenduojamas profilaktikos priemones, informaciją apie sveikatos draudimo įforminimo tvarką) arba pateikia nuorodas į šią informaciją. Informacija arba nuorodos į oficialius internetinius tinklapius, kur yra tokia informacija, skelbiama kelionių organizatoriaus internetiniame puslapyje www.novaturas.lt ir/ar šios sutarties prieduose. 1.1.5.Prieš pasirašant sutartį suteikti informaciją apie sveikatos, gyvybės, neįvykusios kelionės rizikos bei kitus draudimus. 1.1.6.Užtikrinti turistui (-ams) visų sutartyje nurodytų paslaugų tinkamą teikimą, atsižvelgdamas į turisto teisėtus lūkesčius, nepaisant to, ar tas paslaugas turi teikti pats kelionių organizatorius ar kiti turizmo paslaugų teikėjai. 1.1.7.Esant galimybei prieš kelionę, o jos nesant – kelionės pradžioje rašytine forma turistui pateikti: kelionių organizatoriaus atstovo pavardę, adresą, telefono numerį ir elektroninio pašto adresą ar vietinių agentūrų ar agentų, į kuriuos turistas galėtų kreiptis pagalbos, adresus ir telefono numerius, jei tokių agentūrų ar agentų nėra, turistui nurodyti telefono numerį, kuriuo jis galėtų skambinti nenumatytu atveju, ar informaciją, kuri jam padėtų susisiekti su kelionių organizatoriumi. 1.1.8.Turisto(-ų) pateiktus asmens duomenis naudoti tik kelionės dokumentųm įforminimui ir kelionės paslaugų užsakymui. 1.1.9.Be nepagrįsto delsimo suteikti turistui, kuriam kyla sunkumų, reikalingą pagalbą kelionės metu ar esant nenugalimos jėgos aplinkybėms: 1.1.9.1. teikti atitinkamą informaciją apie sveikatos priežiūros paslaugas, vietos valdžios institucijas ir konsulinę pagalbą; 1.1.9.2. padėti turistui pasinaudoti nuotolinio ryšio priemonėmis; 1.1.9.3. padėti rasti alternatyvių kelionės paslaugų. 1.2. Turistas(ai) įsipareigoja: 1.2.1. Atlikti mokėjimus: 1.2.1.1. Sudarant sutartį dėl poilsio kelionių lėktuvu: jeigu iki kelionės pradžios lieka daugiau kaip 4 savaitės, sumokėti 20% dydžio avansą ir likutį sumokėti ne vėliau kaip 4 savaitės iki išvykimo. Jeigu sudarant sutartį iki kelionės pradžios lieka mažiau kaip 4 savaitės, turistas turi iš karto sumokėti už kelionę visą kainą; Turistui atsisakius kelionės, jo sumokėtas avansinis mokėjimas laikomas atlyginimu kelionių organizatoriui už kelionės užsakymo sukūrimą ir aptarnavimą ir turistui nėra grąžinamas, taikantšios sutarties 2.2 punkte nurodytas sąlygas. Kelionių organizatoriaus paskelbtų akcijų metu gali būti nustatoma kita apmokėjimo už paslaugas tvarka, kurios privalo laikytis turistas. Pirkdamas kelionę išsimokėtinai, turistas privalo laikytis atitinkamoje sutartyje numatytos apmokėjimo už paslaugas tvarkos. Jeigu turistas vyksta į kelionę reguliariuoju skrydžiu, taikoma konkretaus oro vežėjo nustatyta atsiskaitymo už skrydžio bilietus tvarka. Gali būti reikalaujama sumokėti skrydžio bilietų kainą iškart po kelionės užsakymo. Jeigu turistas, užsakydamas kelionę, vykdomą reguliariuoju skrydžiu, perka papildomas paslaugas (pvz. pirmenybinio įlaipinimo, registruotą bagažą ar kt.), gali būti reikalaujama sumokėti ne tik skrydžio bilietų, bet ir papildomų paslaugų kainą iškart po kelionės užsakymo. SVARBU! Skrendant su reguliariojo skrydžio vežėju nusipirkus bilietą (ar kelionės paketą) į abi puses ir nepanaudojus vieno skrydžio segmento – kitas skrydžio segmentas anuliuojamas automatiškai, už jį pinigai nėra grąžinami. 1.2.2. Laiku pateikti visą informaciją ir dokumentus reikalingus kelionių organizatoriui įvykdyti šią sutartį; laiku atvykti į nurodytą kelionės pradžios vietą, laikytis organizatoriaus nurodymų dėl kelionės ar atskirų jos dalių vykdymo; laikytis viešosios tvarkos, tarptautinių keleivių vežimo taisyklių, bagažo gabenimo tvarkos ir į šalį įvežamų daiktų kiekio, skaičiaus ir draudimų reikalavimų. Vykdyti pasienio ir muitinės tarnybų nurodymus. Vykstant į kelionę su nepilnamečiais vaikais, laikytis Lietuvos Respublikos Vyriausybės nutarimu patvirtintos Vaiko laikino išvykimo į užsienio valstybes, nepriklausančias Šengeno erdvei, tvarkos aprašo reikalavimų. 1.2.3. Atlyginti kelionės metu padarytą žalą (sugadintą viešbučio inventorių, transporto priemones ir kt.). Jeigu žala padaryta nepilnamečio, visus nuostolius už jį apmoka atsakingas asmuo. Jeigu turistas prisiima kaltę ir sutinka atlyginti žalą, žalą reikia atlyginti vietoje. Tais atvejais, kai turistas kaltės neprisiima, kelionių organizatorius turi teisę žalą išieškoti Lietuvos Respublikos teisės aktų nustatyta tvarka. Turistas neprivalo atlyginti žalos atsiradusios dėl nenugalimos jėgos. 1.3. DĖMESIO! Neįgalūs arba judėjimo apribojimų turintys asmenys, kuriems kelionės lėktuvu metu gali būti reikalinga speciali pagalba, dėl sėdėjimo vietų patvirtinimo privalo susitarti su faktiniu skrydžio vykdytoju arba kelionių organizatoriumi prieš įsigyjant vežimo bilietą arba organizuotos turistinės kelionės paketą. Skirtingos avialinijos judėjimo apribojimų turinčiais asmenimis taip pat laiko regėjimo, klausos ar protinę negalią turinčius asmenis. Tokiu būdu, judėjimo apribojimų turintys asmenys ar jų atstovai bei atstovai vaikų, keliausiančių be suaugusiųjų palydos, privalo apie tai informuoti faktinį skrydžio vykdytoją arba kelionių organizatorių. Tam tikrais atvejais asmens psichinė, emocinė, fizinė ar kitokia medicininė būklė gali daryti neigiamą įtaką skrydžio metu tiek pačiam turistui, tiek kartu keliaujantiems asmenims (asmenys su spec. poreikiais, širdies stimuliatoriais, kvėpavimo aparatais, širdies ligomis, besiruošiantys operacijoms ir pan.). Todėl šie turistai prieš sudarant organizuotos turistinės kelionės sutartį, privalo pasitarti su medikais ir gauti jų leidimą ar rekomendacijas dėl kelionės, kartu įvertinant galimas rizikas jos metu. Neįspėjus apie sveikatos būklę ar galimas rizikas bei nesuderinus skrydžio su skrydį vykdančiu vežėju ar kelionių organizatoriumi, turistas prisiima visas galimas tokio elgesio rizikas ir neigiamas pasekmes. Pažymėtina, kad pagal skirtingų avialinijų bendrąsias keleivių vežimo sąlygas, vežėjas turi teisę atsisakyti tokį keleivį vežti. Neįgaliems ir judėjimo apribojimų turintiems asmenims ikisutartinių santykių metu taip pat rekomenduojama su kelionių pardavimo agentu ar kreipiantis į kelionių organizatorių tiesiogiai išsiaiškinti, ar konkretus viešbutis bei apie aplink viešbutį esančios infrastruktūros bus pritaikyta neįgaliesiems. 1.4. Turistas, pagrindinė šios sutarties šalis, privalo informuoti kitus turistus - naudos gavėjus, kad kelionė yra organizuojama tik pagal šioje sutartyje nurodytas sąlygas ir visi turistai privalo vykdyti visas sutarties sąlygas bei pateikti jiems visą po sutarties sudarymo kelionių organizatoriaus siunčiamą informaciją.

2. TEISĖ ATSISAKYTI SUTARTIES 2.1. Turistas turi teisę bet kuriuo metu nutraukti sutartį iki kelionės pradžios. 2.2.Turistui nutraukus sutartį, kelionių organizatorius gali reikalauti iš turisto sumokėti pagrįstą sutarties nutraukimo mokestį, nustatytą sutartyje. Šalys susitaria ir sutinka, kad nuostolių dėl turisto sutarties atsisakymo dydis priklausomai nuo atsisakymo laiko yra: 

Kelionėms į poilsines keliones lėktuvu:

Turistui atsisakius kelionės, vykdomos reguliariuoju skrydžiu, skrydžio bilietų kaina nėra grąžinama. 2.3. Turistas turi teisę nutraukti sutartį ir nemokėti sutarties nutraukimo mokesčio šiais atvejais: 2.3.1. jeigu kelionių organizatorius iki kelionės pradžios pakeičia sutarties sąlygas, o turistas per kelionių organizatoriaus nurodytą protingą terminą nesutinka su kelionių organizatoriaus siūlomais sutarties sąlygų pakeitimais, kai: a) kelionių organizatorius iki kelionės pradžios yra priverstas iš esmės pakeisti bet kurią iš pagrindinių kelionės paslaugų ir (ar) ypatumų; b) kelionių organizatorius negali įvykdyti sutartyje nurodytų specialių turisto reikalavimų; c) kelionių organizatorius pasiūlo padidinti kelionės kainą daugiau kaip 8 procentais pagal Lietuvos Respublikos civilinio kodekso (toliau – Civilinis kodeksas) 6.7521 straipsnį. 2.3.2. jeigu dėl turisto nurodytų trūkumų sutartis negali būti toliau vykdoma, o kelionių organizatorius per turisto nustatytą protingą laikotarpį nepašalina trūkumų. Civilinio kodekso 6.7521 straipsnio 3 dalyje numatytais atvejais turistas gali prašyti sumažinti kelionės kainą arba atlyginti turtinę ir neturtinę žalą; 2.3.3. jeigu kelionės tikslo vietoje ar visiškai greta atsiranda nenugalimos jėgos aplinkybių, dėl kurių gali tapti neįmanoma vykdyti kelionę ar nuvežti turistus į kelionės tikslo vietą. Tokiu atveju turistas turi teisę reikalauti, kad jam būtų grąžinti už kelionę sumokėti pinigai, tačiau jam nesuteikiama teisė papildomai gauti žalos atlyginimą. 2.4. Kelionių organizatorius turi teisę iki kelionės pradžios nutraukti sutartį, grąžinti turistui visas už kelionę sumokėtas sumas ir atlyginti turisto patirtą žalą, išskyrus 2.5 punkte nurodytais atvejais. 2.5. Kelionių organizatoriui nutraukus sutartį turisto patirta žala neatlyginama šiais atvejais: 2.5.1. kelionę įsigijusių asmenų skaičius yra mažesnis nei sutarties 1.1.2 punkte nurodytas minimalus turistų skaičius ir apie tai turistas buvo informuotas sutarties 1.1.2 punkte nustatyta tvarka; 2.5.2. kelionių organizatorius negali įvykdyti sutarties dėl nenugalimos jėgos ir jis nedelsdamas iki kelionės pradžios praneša turistui apie sutarties nutraukimą. 2.6. Kai kelionių organizatoriui ar kelionių pardavimo agentui atsiranda pareiga grąžinti turistui visus ar dalį už kelionę sumokėtų pinigų, pinigai turi būti grąžinti į turisto nurodytą sąskaitą per 14 dienų nuo sutarties nutraukimo dienos.

3. SUTARTIES KAINOS IR SĄLYGŲ PAKEITIMAS 3.1. Kelionių organizatorius po sutarties sudarymo turi teisę didinti kelionės kainą. Kelionių organizatorius patvariojoje laikmenoje aiškiai ir suprantamai informuoja turistą apie kainos padidinimą likus ne mažiau kaip 20 dienų iki kelionės pradžios, nurodydamas kainos padidėjimo priežastis ir kaip buvo apskaičiuotas kainos padidėjimas. Jeigu kelionės kainos padidinimas viršija 8 procentus galutinės kelionės kainos, turistas turi teisę nutraukti sutartį ar pasirinkti kelionių organizatoriaus siūlomą alternatyvią kelionę.

3.2. Kelionės kainos didinimas galimas tik tuo atveju, kai jį tiesiogiai lemia pasikeitęs (-usi): turistų vežimo kaina dėl degalų ar kitų energijos šaltinių išlaidų; su į sutartį įtrauktų paslaugų, susijusių mokesčių ar rinkliavų (pvz. turisto rinkliava, oro uosto mokesčiai, kt.), kuriuos taiko tretieji asmenys, tiesiogiai nedalyvaujantys vykdant kelionę, dydis; su kelione susijusios valiutos keitimo kursas. 3.3. Turistas po sutarties sudarymo turi teisę reikalauti sumažinti kelionės kainą šiais atvejais: sumažėjus sutarties 3.2 punkte nurodytoms išlaidoms po sutarties sudarymo,  bet iki kelionės pradžios; dėl netinkamo sutarties vykdymo, nebent kelionių organizatorius įrodo, kad sutartis vykdoma netinkamai dėl turisto kaltės; kai dėl siūlomų alternatyvių paslaugų kelionė tampa žemesnės kokybės, nei nurodyta sutartyje; jeigu kelionės organizatorius dėl pagrįstų priežasčių negali pasiūlyti alternatyvių paslaugų arba turistas jų atsisako pagal Civilinio kodekso 6.754 straipsnio 5 dalį; jeigu dėl turisto nurodytų trūkumų sutartis negali būti toliau vykdoma, o kelionių organizatorius per turisto nustatytą pagrįstą laikotarpį nepašalina trūkumų. Sumažinus kelionės kainą, kelionių organizatorius turi teisę iš turistui turimos sugrąžinti sumos išskaičiuoti faktines administracines išlaidas. Turisto prašymu kelionės organizatorius turi pateikti tokių administracinių išlaidų pagrindimą. 3.4. Kelionių organizatorius iki kelionės pradžios turi teisę vienašališkai keisti kitas sutarties sąlygas tik esant visoms šioms sąlygoms: pakeitimai nėra esminiai; kelionių organizatorius turisto pageidaujama forma patvariojoje laikmenoje aiškiai ir suprantamai pateikė turistui informaciją apie pakeitimus. Kelionių organizatorius be nepagrįsto delsimo patvariojoje laikmenoje aiškiai ir suprantamai turi pateikti turistui informaciją apie: siūlomus sutarties pakeitimus; protingą terminą, per kurį turistas turi informuoti kelionių organizatorių apie savo sprendimą; pasekmes, jei turistas neatsakytų per kelionių organizatoriaus nurodytą terminą; alternatyvią kelionę ir jos kainą, kai tokia kelionė pasiūloma. Turistas turi teisę savo pasirinkimu per kelionių organizatoriaus nurodytą protingą terminą sutikti su kelionių organizatoriaus siūlomais sutarties sąlygų pakeitimais ar nutraukti sutartį nemokėdamas sutarties nutraukimo mokesčio. Turistui nutraukus sutartį, kelionių organizatorius gali turistui pasiūlyti lygiavertę ar aukštesnės kokybės kitą kelionę. Jei dėl sutarties pakeitimų ar pasirinktos alternatyvios kelionės suprastėja kelionės kokybė ar sumažėja jos kaina, turistas turi teisę reikalauti grąžinti sumažėjusios kainos skirtumą. 3.5. Po sutarties sudarymo abiejų šalių rašytiniu susitarimu gali būti keičiama bet kuri sutarties sąlyga.

4. SUTARTIES ŠALIŲ PASIKEITIMAS 4.1. Turistas turi teisę, likus iki kelionės pradžios ne mažiau kaip 7 dienoms ir kelionių organizatoriui pateikus pagrįstą pranešimą, perleisti savo teisę į kelionę trečiajam (kelionę perimančiam) asmeniui, kuris įgys visas turisto teises ir pareigas pagal sutartį, perleidimą įforminant sutartimi. 4.2. Tais atvejais, kai toks perleidimas prieštarauja asmens, kurio pagalba kelionių organizatorius naudojasi, taisyklėms (t.y. jei per laiką, likusį iki kelionės pradžios jau neleidžiama užsakyti vietos transporto priemonėje, viešbutyje ir (ar) gauti vizos naujo asmens vardu), sutarties šalies (-ių) keitimas nėra galimas. 4.3. Jeigu kelionės perleidimas yra neįmanomas dėl 4.2. punkte minėtų ar kitų priežasčių, turistas turi teisę nutraukti sutartį, sumokėdamas 2.2. punkte nurodytą nutraukimo mokestį. 4.4. Sutarties šalių pakeitimui taikomas administravimo mokestis:

*Tais atvejais, kai asmuo, kurio pagalba kelionių organizatorius naudojasi, yra nustatęs atitinkamą mokestį, kurio nepadengia kelionių organizatoriaus nurodytas sutarties šalių keitimo administravimo mokestis, perleidimas gali būti atliekamas tik turistui (-ams) sumokėjus atitinkamą mokestį. 4.5. Teisę į kelionę perleidžiantis turistas ir trečiasis (kelionę perimantis) asmuo, perėmęs kelionę, atsako solidariai kelionės organizatoriui už kelionės kainos ir išlaidų, susijusių su teisės į kelionę perleidimu, sumokėjimą. Turistui pareikalavus, kelionių organizatorius privalo pateikti dėl sutarties šalių pasikeitimo turėtų papildomų išlaidų paskaičiavimą.

5. KELIONĖS KEITIMAS 5.1. Turistas, įsigijęs poilsinę kelionę lėktuvu užsakomaisiais skrydžiais, turi galimybę iki kelionės pradžios likus ne mažiau kaip 14 dienų, pakeisti kelionės datą, trukmę, viešbutį ir/ar kambario tipą, kelionės kryptį ir/ar sezoną. Šiuo atveju taikomi ne mažesni nei žemiau nurodyti kelionės keitimo mokesčiai: 

Kelionės keitimo sąlygos netaikomos egzotiškoms poilsinėms ir slidinėjimo kelionėms lėktuvu. 5.2. Keičiant kelionės datą, trukmę, viešbutį, kambario tipą ir/arba kryptį, sezoną, kelionės kaina perskaičiuojama pagal keitimo dieną galiojančias kainas ir sąlygas. 5.3. Kelionės keitimas galimas tik tuo atveju, jei tai yra įmanoma, t.y. galimos kitos datos/trukmės/viešbučiai, yra laisvų vietų skrydžiose ir pan. Keliaujančių asmenų skaičius bei keliaujantys asmenys (jų vardai ir pavardės) negali būti keičiami.

6. ATSAKOMYBĖ UŽ NETINKAMĄ SUTARTIES VYKDYMĄ 6.1. Kelionių organizatorius atsako už bet kokius techninius užsakymo sistemos trūkumus, kurių atsirado dėl jo kaltės sudarant sutartį ir už bet kokias užsakymo proceso metu padarytas klaidas. Atsakomybė netaikoma, kai užsakymo klaidos atsirado dėl turisto kaltės arba jas sukėlė nenugalimos jėgos aplinkybės. 6.2. Kelionių organizatorius privalo be nepagrįsto delsimo suteikti turistui, kuriam kyla sunkumų, reikalingą pagalbą, nurodytą sutarties 1.1.9 punkte. 6.3. Jei pagalba turistui yra reikalinga dėl priežasčių, kurios atsiranda dėl turisto tyčinių veiksmų ar aplaidumo, kelionių organizatorius turi teisę už tokios pagalbos teikimą imti atlygį, kurio dydis negali viršyti kelionių organizatoriaus patirtų faktinių išlaidų.

6.4. Turistas be nepagrįsto delsimo turi pranešti kelionių organizatoriui sutartyje nurodytais kontaktais apie bet kokį netinkamo sutarties vykdymo ar sutarties nevykdymo atvejį, jo pastebėtą kelionės metu ir nurodyti protingą terminą trūkumams ištaisyti. Jeigu trūkumus būtina ištaisyti nedelsiant, turistas neprivalo nurodyti termino. 6.5. Jeigu sutartyje nurodytos paslaugos teikiamos ne pagal sutarties sąlygas, kelionių organizatorius per turisto nustatytą protingą terminą privalo ištaisyti turisto nurodytus trūkumus, išskyrus kai to padaryti neįmanoma arba jei tai sukeltų neproporcingų išlaidų, atsižvelgiant į trūkumų mastą ir į netinkamai suteiktų paslaugų, nurodytų sutartyje, vertę. 6.6. Jeigu kelionių organizatorius neištaiso trūkumų dėl sutarties 6.5 punkte nurodytų priežasčių, turistas turi teisę reikalauti, kad jam be nepagrįsto delsimo būtų atlyginta turtinė ir neturtinė žala. 6.7. Jeigu kelionių organizatorius per turisto nustatytą protingą terminą neištaiso trūkumų ne dėl sutarties 6.5 punkte nurodytų priežasčių, turistas gali padaryti tai pats ir pareikalauti padengti būtinas išlaidas. 6.8. Jeigu kelionių organizatorius negali suteikti didelės paslaugų dalies pagal sutartį  arba turisto sugrįžimo į išvykimo vietą paslauga nesuteikiama taip, kaip buvo susitarta, kelionių organizatorius privalo pasiūlyti turistui be papildomų išlaidų tinkamas alternatyvias paslaugas, kurių kokybė, jeigu įmanoma, būtų lygiavertė sutartyje nurodytai kokybei arba aukštesnė už ją, kad būtų galima toliau tęsti kelionę. Kai dėl siūlomų alternatyvų kelionė tampa žemesnės kokybės nei nurodyta sutartyje, kelionių organizatorius atitinkamai sumažina kelionės kainą. 6.9. Jei pasiūlytos alternatyvos nėra panašios į tas paslaugas, dėl kurių buvo susitarta sutartyje, arba, jei suteiktas kainos sumažinimas yra neadekvatus, turistas gali jų atsisakyti. 6.10. Jei nepakankama atitiktis iš esmės daro poveikį kelionės vykdymui, o organizatorius per turisto nustatytą pagrįstą laikotarpį padėties neištaiso, turistas gali nutraukti sutartį nemokėdamas sutarties nutraukimo mokesčio ir paprašyti sumažinti kainą ir (arba) atlyginti turtinę ir neturtinę žalą. 6.11. Jeigu nėra įmanoma pasiūlyti alternatyvų arba turistas atsisako pasiūlytų alternatyvų pagal sutarties 6.9 punktą, turistas turi teisę į kainos sumažinimą ir (arba) turtinės ir neturtinės žalos atlyginimą nenutraukiant sutarties. 6.12. Jeigu kelionė apima keleivių vežimo paslaugą, kelionių organizatorius šios sutarties 6.9 – 6.11 punktuose nurodytais atvejais be papildomo užmokesčio turi užtikrinti turisto grąžinimą į pradinę išvykimo vietą lygiavertės rūšies transportu arba nuvežimą į kitą vietovę, dėl kurios sutinka turistas, taip pat grąžinti turistui pinigus už nesuteiktas paslaugas. 6.13. Jeigu dėl nenugalimos jėgos kelionių organizatorius negali užtikrinti turisto grąžinimo taip, kaip numatyta sutartyje, kelionių organizatorius privalo apmokėti būtino apgyvendinimo, kurio kategorija, jeigu įmanoma, yra lygiavertė nurodytajai sutartyje, tam laikotarpiui, kiek trunka nenugalimos jėgos aplinkybės, bet ne ilgesniam kaip trijų nakvynių laikotarpiui kiekvienam turistui, išlaidas, išskyrus atvejus, kai kituose įstatymuose ar Europos Sąjungos teisės aktuose numatyti ilgesni laikotarpiai (pvz., riboto judumo ir juos lydintiems asmenims, nėščiosioms ir nelydimiems nepilnamečiams, taip pat asmenims, kuriems reikia specialios medicinos pagalbos, jei turistas apie jo specialius poreikius praneša kelionių organizatoriui likus ne mažiau kaip 48 valandoms iki kelionės pradžios). 6.14. Turistas turi teisę reikalauti, kad jam be nepagrįsto delsimo būtų atlyginta turtinė ir neturtinė žala šiais atvejais: 6.14.1. jeigu dėl turisto nurodytų trūkumų sutartis negali būti toliau vykdoma, o kelionių organizatorius per turisto nustatytą protingą terminą nepašalina trūkumų; 6.14.2. jeigu kelionės organizatorius dėl pagrįstų priežasčių negali pasiūlyti alternatyvių paslaugų arba turistas jų atsisako pagal sutarties 6.9 punktą; 6.14.3. kitais Civiliniame kodekse nustatytais atvejais. 6.15. Kelionių organizatorius neatsako už netinkamą sutarties įvykdymą, jeigu kelionių organizatorius įrodo, kad sutartis buvo netinkamai vykdoma dėl: 6.15.1. turisto kaltės; 6.15.2. trečiosios šalies, nesusijusios su paslaugų teikimu pagal sutartį, kaltės ir todėl nebuvo įmanoma žalos numatyti arba jos išvengti; 6.15.3. nenugalimos jėgos. 6.16. Jeigu žala, išskyrus žalą, atsiradusią dėl turisto mirties, sveikatos sužalojimo, taipmpat tyčinę žalą ar dėl didelio neatsargumo padarytą žalą, turistui padaroma teikiant sutartyje numatytą paslaugą, tačiau tą paslaugą teikia ne pats kelionės organizatorius, kelionės organizatoriaus atsakomybė už tokią žalą gali būti ribojama triguba kelionės kaina. 6.17. Turisto teisė gauti žalos atlyginimą ar teisė į kainos sumažinimą nedaro poveikio keleivių teisėms pagal 2004 m. vasario 11 d. Europos Parlamento ir Tarybos reglamentą (EB) Nr. 261/2004, nustatantį bendras kompensavimo ir pagalbos keleiviams taisykles atsisakymo vežti ir skrydžių atšaukimo arba atidėjimo ilgam laikui atveju, panaikinantį Reglamentą (EEB) Nr. 295/91 (OL 2004 L 046, p. 1), 2007 m. spalio 23 d. Europos Parlamento ir Tarybos reglamentą (EB) Nr. 1371/2007 dėl geležinkelių keleivių teisių ir pareigų (OL 2007 L 315, p. 14), 2009 m. balandžio 23 d. Europos Parlamento ir Tarybos reglamentą (EB) Nr. 392/2009 dėl keleivių vežėjų jūra atsakomybės avarijų atveju (OL 2009 L 131, p. 24), 2010 m. lapkričio 24 d. Europos Parlamento ir Tarybos reglamentą (ES) Nr. 1177/2010 dėl jūrų ir vidaus vandenų keliais vykstančių keleivių teisių, kuriuo iš dalies keičiamas Reglamentas (EB) Nr. 2006/2004 (OL 2010 L 334, p. 1), 2011 m. vasario 16 d. Europos Parlamento ir Tarybos reglamentą (ES) Nr. 181/2011 dėl miesto ir tolimojo susisiekimo autobusų transporto keleivių teisių, kuriuo iš dalies keičiamas Reglamentas (EB) Nr. 2006/2004 (OL 2011 L 55, p. 1), ir pagal tarptautines konvencijas. 6.18. Pagal sutarties 6.14 punktą kelionių organizatoriaus išmokėtas žalos atlyginimas arba kelionių organizatoriaus turistui suteiktas kainos sumažinimas ir pagal sutarties 6.17 punkte nurodytus Europos Sąjungos teisės aktus ir tarptautines konvencijas išmokėtas žalos atlyginimas arba suteiktas kainos sumažinimas turistui išskaitomi vienas iš kito, kad būtų išvengta dvigubo žalos atlyginimo. 6.19. Turistui padaryta turtinė ir neturtinė žala atlyginama Civilinio kodekso nustatyta tvarka.

7. BENDROSIOS SĄLYGOS 7.1. Turisto teises gina Civilinis kodeksas, Vartotojų teisių apsaugos įstatymas,Reklamos įstatymas, Turizmo įstatymas bei kiti įstatymai ir poįstatyminiai teisės aktai bei ši sutartis. 7.2. Kelionės metu atsiradusias pretenzijas dėl šios sutarties netinkamo vykdymo ar nevykdymo, turistas turi be ne pagrįsto delsimo raštu ar patvariojoje laikmenoje pareikšti kelionių organizatoriaus vietiniam atstovui arba kelionių vadovui, o jei šių nėra, – kelionių organizatoriui. 7.3. Kai sutartis sudaryta per kelionių pardavimo agentą, turistas gali pateikti pranešimus, prašymus ar pretenzijas tiesiogiai kelionių pardavimo agentui, kuris be nepagrįsto delsimo perduoda pranešimus, prašymus ar pretenzijas kelionių organizatoriui. Kelionių pardavimo agentui gavus turisto pranešimus, prašymus ar pretenzijas, laikoma, kad juos gavo kelionių organizatorius. 7.4. Kelionių organizatorius privalo neatlygintinai išnagrinėti turisto kreipimąsi ir, kai nesutinka su turisto reikalavimais, privalo ne vėliau kaip per 14 dienų nuo turisto kreipimosi gavimo dienos, pateikti turistui išsamų motyvuotą rašytinį atsakymą. Turistui prašant, kelionių organizatorius privalo pateikti turistui dokumentus ar kitus įrodymus, pagrindžiančius kelionių organizatoriaus atsakymą. 7.5. Kelionių organizatoriaus vidinė pretenzijų nagrinėjimo tvarka: 7.5.1. Turisto pretenzijos pateiktos kelionės metu yra sprendžiamos vietoje bendraujant su kelionių organizatoriaus vietiniu atstovu ir rašytinis atsakymas į minėtas pretenzijas turistui nėra pateikiamas. 7.5.2. Nepavykus konflikto išspręsti vietoje, pretenzijas kelionių organizatoriui turistas gali pareikšti raštu el. paštu [email protected] . Turistų pretenzijų kelionių organizatoriui dėl žalos atlyginimo už netinkamą sutarties vykdymą ar nevykdymą pateikimo senaties terminas yra dveji metai. 7.5.3. Jeigu pretenziją pateikia turisto įgaliotas asmuo, jis taip pat turi pridėti turisto atstovavimą patvirtinančius dokumentus. 7.6. Ginčai dėl sutarties netinkamo vykdymo ar nevykdymo ne teisme nagrinėjami Lietuvos Respublikos vartotojų teisių apsaugos įstatymo nustatyta tvarka Valstybinėje vartotojų teisių apsaugos tarnyboje, adresu Vilniaus g. 25, 01402 Vilnius, el. p. [email protected], faks. (8 5) 279 1466, interneto svetainė www.vvtat.lt. Elektroniniu būdu prašymą galima pateikti per EGS platformą http://ec.europa.eu/odr/. 7.7. Po šios sutarties pasirašymo, sutarties sąlygų esminiai pakeitimai (pagrindinė sutartų paslaugų dalis ir kaina) galimi tik abiejų šalių rašytiniu susitarimu.

7.8. Sutartis sudaryta dviem egzemplioriais - po vieną kelionių organizatoriui ir turistui (-ams). Visi egzemplioriai turi vienodą juridinę galią. Jeigu sutartis sudaroma nuotoliniu būdu, kelionių organizatorius be nepagrįsto delsimo po sutarties sudarymo patvariojoje laikmenoje turistui pateikia sutarties kopiją arba sutarties patvirtinimą.

8. ASMENS DUOMENŲ APSAUGA 8.1. Teikdamas turizmo paslaugas kelionių organizatorius, kaip duomenų valdytojas, renka ir tvarko turisto ir su juo kartu keliaujančių asmens duomenis, pateikiamus sutarties pasirašymo metu bei kitus su turizmo paslaugų teikimu susijusius duomenis. Šie duomenys yra tvarkomi sutarties sudarymo ir vykdymo pagrindu, taip pat vykdant kelionių organizatoriui taikomus teisės aktų reikalavimus ir siekiant teikti turizmo paslaugas. Atsisakius pateikti šiuos duomenis kelionių organizatorius turi teisę atsisakyti sudaryti sutartį. 8.2. Duomenis kelionių organizatorius tvarko teisės aktų nustatytą terminą arba tiek, kiek yra būtina tvarkymo tikslams pasiekti. Duomenys gali būti perduoti kelionių organizatoriaus grupės įmonėms, taip pat partneriams, paslaugų teikėjams ar kitiems tretiesiems asmenims tiek, kiek tai yra būtina sutarties ar kelionių organizatoriaus teisinių pareigų vykdymui, įskaitant duomenų perdavimą į trečiąsias valstybes, esančias už Europos Ekonominės Erdvės ribų, kuriose gali būti taikomi mažesni reikalavimai duomenų apsaugai. Kelionių organizatorius deda pagrįstas pastangas siekiant užtikrinti tinkamas duomenų apsaugos priemones. 8.3. Turistas turi teisę prašyti, kad kelionių organizatorius leistų susipažinti su tvarkomais jo asmens duomenimis ir juos ištaisytų arba ištrintų, arba apribotų duomenų tvarkymą, teisę nesutikti, kad duomenys būtų tvarkomi, taip pat teisę į duomenų perkeliamumą ir teisę pateikti skundą priežiūros institucijai. 8.4. Turistas, pateikdamas kitų turistų asmens duomenis, tame tarpe vaikų ir (ar) specialių kategorijų asmens duomenis patvirtina, kad asmuo arba teisėtas jo atstovas (pavyzdžiui, vienas iš tėvų, globėjų) sutinka su tokiu duomenų teikimu ir tvarkymu, taip pat įsipareigoja pateikti jiems informaciją, nurodytą šioje sutartyje bei kelionių organizatoriaus viešai skelbiamoje Privatumo politikoje. Kelionių organizatorius turi teisę kreiptis į asmenį nurodytu telefono numeriu ar el. pašto adresu siekiant įsitikinti, kad toks sutikimas buvo duotas. 8.5. Daugiau apie informacijos apie asmens duomenų tvarkymą, duomenų subjekton teises ir jų įgyvendinimo tvarką galima rasti kelionių organizatoriaus viešai skelbiamoje Privatumo politikoje internete www.novaturas.lt, skyrelyje „Svarbi informacija“. Turistas patvirtina, kad susipažino su Privatumo politika.

Sutarties pasirašymas dar negarantuoja, jog turisto pasirinktam viešbučiui bus patvirtinta rezervacija. Nepatvirtinus rezervacijos turistui bus pranešta atskiru pranešimu. Nepatvirtinus rezervacijos, pasirašyta sutartis, dėl apgyvendinimo konkrečiame viešbutyje, netenka galios. Turistas turi teisę pasirinkti alternatyvų kelionės variantą sudarydamas naują sutartį. Turistui atsisakius sudaryti naują sutartį, kelionių organizatorius turi grąžinti turistui įmokėtus pinigus už netekusią galios sudarytą sutartį.

Užsienio valstybių, neturinčių bevizio režimo susitarimo su Lietuvos Respublika, piliečiams, įsigijusiems turistinę kelionę, kai išvykimas/grįžimas iš/į Lietuvą, būtina daugkartinė (Šengeno arba nacionalinė) viza, galiojanti ne trumpiau kaip kelionės laikotarpiu (išsami informacija yra skelbiama interneto svetainėje www.migracija.lt).

Šios organizuotos turistinės kelionės sutarties nuostatos privalomos kelionių organizatoriui ir visiems turistams. One of the most popular tours of my guests is a walk through Moscow at night. This tour helps tourists to see Moscow not as a bustling hive, but as a majestic Empress full of ceremonial glory. A wonderful excursion begins with perhaps the most famous places in the whole Moscow - Red Square , located at the north-eastern wall of the Kremlin. History of Russia's main square has its roots in the end of 15th century.

Nowadays, parades and celebrations of important events in the life of the Russian Federation are held at this famous square. At night Red Square stuns with its magnificent illuminations. Solemn and austere in daylight, it looks elegant and festive in the glow of night lights.

Patriarchy Bridge

Our path lies to the Patriarchy Bridge than. There is a beautiful view of the night Red Square, The Cathedral of Christ the Savior and the monument to Peter the Great at this point.

Built in Russian-Byzantine style in honor of the victory of the Russian people over Napoleon's troops the magnificent Cathedral of Christ the Savior seems to be a magical castle from a fairy tale, full of mysterious charm. Its white silhouette stands out brightly against the night sky. It seems that the walls of the Cathedral lit from within by the divine light. It is really a stunning effect.

Sparrow Hills

Next place that deserves special attention are the Sparrow Hills . There is a unique view on Moscow at night with bird's-eye view from this place - at least 85 meters over of the Moscow-River. Looking at the capital full of illumination, lit by millions of lights, stretching out at the feet, you feel on top of the world. It seems that you are a magician, surveying your luxurious land. You will have the opportunity to see a spectacular view of the Luzhniki stadium - the largest one in Russia and one of the largest stadiums in the world. This stadium was built in 1955-1956 years. It was here the Olympic Games took place and a lot of sport competitions and concerts of well-known artists and bands were conducted.

At night the stadium is light up along the whole circular length at night. It seems that the stadium is a great shining pearl in the illumination of thousands of lights. From this point of Moscow you can see the erecting buildings of Financial Center Moscow-City by projects of English architect Norman Foster. Some buildings are ready; some are in the process of erection. Completion is planned for 2015. We all look forward to completion to enjoy the magnificent view of monumental modern buildings at night in the rays of illumination.

All of Stalin's skyscrapers , erected in the mid 50-ies by the orders of Stalin are visible from the top of Sparrow Hills, including Moscow State University , known for its night laser lights. Each skyscraper has a unique lighting. Panorama from Sparrow Hills is sure to impress guests: dazzling shining of metropolis with millions of lights makes the capital an unforgettable and beautiful. Magic night in Moscow fascinates.

Novodevichy Convent

My guests are particularly impressed by the panorama of Novodevichy Convent .

This magnificent example of the Orthodox women's monastery was founded in 1524 by Prince Vasily III. There are a lot of stories and legends of Moscow connected with the monastery. It played a prominent role in the cultural life of Russia. Today Novodevichy Convent is both working monastery and a branch of the State Historical Museum. Night walk along the pond will fully appreciate the beauty of the Novodevichy convent at night. Rising above the dark surface of the water, it seems to be full of shining, light and peace. The lights of the five-headed Smolensky Cathedral and the monumental bell tower of the monastery illuminate the dark sky solemnly, cutting through the darkness and giving hope.

Victory Park

Three hours driving and walking tour ends in Victory Park on Kutuzov Avenue with a stop near the Arch of Triumph.

«First acquaintance with Moscow» – a 2.5-hour city tour in the center of Moscow

This Moscow city tour starts on the Theater Square, past Lubyanka Square and the KGB-building, then through Kitay Gorod district and Varvarka Street, past the world-famous St. Basil’s Cathedral. Then it goes across Zarjadje Park, over Red Square at the Lenin Mausoleum, the GUM-department store and towards the Historical Museum. We walk through the Alexander Garden.

A 3.5-hour car/bus tour of Moscow.

This is the best tour of Moscow city as all the important sights are visited. I am your Moscow city guide who will walk you through the city explaining the charming history of the city. This tour begins with picking you up from the hotel. 3 breaks are offered for photographing.

First, we will visit the most famous riverside streets and bridges in the center of the city with the most beautiful views of the Kremlin and the Moskva River (e.g. the Kremlin embankment and the Great Stone Bridge).

The first photo break is made at the Cathedral of Christ the Savior. We then pass by the district with numerous museums, Prechistinka Street and the district with numerous medical areas.

Mother Russia has undergone a lot in its long life. Since ancient times, Russian rulers have taken nearly all political power into their own hands. By the beginning of the 20th century, the Russian oppositional movement was deadly set for the total destruction of the ever-lasting tsarist regime. All of Russia got involved in the bloody revolution of 1917 in an effort to abolish the current state of the government and gain freedom for the ordinary people.

You will learn about the every-day life of the Soviet people during the bloody Second World War with the Nazis, including the legendary Battle for Moscow, the 900-day siege of Leningrad, the hardships that local citizens went through, the consequences of the war and the scars it left on the Soviet people, as well as why the Cold War happened and what was the fundamental reason.

In the city that is as much about wars as it is about victories, there is one essential stopover - the Museum of the Great Patriotic War (that's what WWII is called in Russia). Must-do for those wishing to understand Russia's past and look at the whole war from the different perspective - Russian.

The museum is not for the faint-hearted. Here you can see films about the partisan experience, the scenes that will haunt you forever (no subtitles, but they are not necessary).
